40-10 Amend 309.99 Fees - to correct typo

Ordinance No.: 40-10 ANTONIO, BULLOCK, BUTLER, BHt9ADIGAN, PO`nIERS, SMITH, SUMMERS AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at least five (5) members elected to Council otherwise, it shall take effect and be in force after the earliest period allowed by law, amending Section 309.99, Fees, within the Codified Ordinances of the City of Lakewood for the purpose of correcting a typographical error. WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal departments in that Chapter 309 of the Lakewood Codified Ordinances takes effect August 1, 2010. Now,. therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 309.99 of the Lakewood Codified Ordinances currently reading as follows: 309.99 Fees. (A) Whoever violates Section 351.01(a) through (p), (r) or (s) through Section 351.18 or Section 351.20(b) or (c) or Section 351.23(a), (b), (c) or (d) shall be charged thirty five dollars ($35.00) except that if such fee is paid in full within seventy-two hours such fee shall be reduced to twenty-five dollars ($25.00). (B) Whoever violates Section 351.01(q) or Section 351.27 shall be charged thirty five dollars ($45.00) except that if such fee is paid in full within seventy-two hours such fee shall be reduced to thirty-five dollars ($35.00). (C) Whoever violates Section 351.23(f) shall be charged two hundred fifty dollars ($250.00) except that if such fee is .paid within seventy-two hours, such fee shall be two hundred dollars ($200.00). Anyone admitting to violating Section 351.23(f) and showing that the offender or the person for who's benefit the vehicle was being operated had been issued a removable windshield placard that then was valid, parking card, or special license plates that then were valid but the offender or the person failed to display the placard or special license plates as described in Section 351.23(f)(1)A. or B. shall be charged one hundred dollars ($100.00).
