PLEASE SUBSTITUTE FOR ORDINANCE NO. 45-10 PLACED ON 1~ READNNG & REFERRED TO THE PUBLIC WORKS COMMITTEE 6/21/10, ZND READING 7/6/10) ORDINANCE N0. 45-10 BY: Antonio, Bullock, Butler, Madigan., Smith, Summers. AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at least five (5) members elected to Council, otherwise, it shall be in effect and be in force after the earliest period allowed by law, to strengthen ethical protections in the City of Lakewood against soliciting or receiving improper compensation. WHEREAS, it is vital to the health, safety, and long-term viability of the City of Lakewood to keep Lake Erie water clean and free of raw sewage overflows; and WHEREAS, on-site storm water management could help our City sewer district get into, and lower the cost of, compliance with Clean Water Act requirements mandated by the U.S. EPA; BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, in the COUNTY OF CUYAHOGA AND STATE OF OHIO: Section 1. That 1306.29(c), which currently reads as follows: 1306.29 SAFETY AND SANITATION. (c) All roofs of every dwelling and occupiable structure shall be maintained weather- tight, water-tight, shall match and conform in their entirety to the existing design and color, and shall be equipped with gutters and downspouts connected to a public storm sewer, provided, however, with the approval of the City Engineer, downspouts may discharge onto splash pads or other devices if a nuisance shall not be created to adjoining property. is hereby amended to read as follows:
