PLEASE SUBSTITUTE FOR ORDINANCE 49-10 <br />PLACED ON 1~ READING & REFERRED TO THE PUBLIC SAFETY <br />COMMITTEE 6/21/10, 2"d ~ADINDG 7/6/10), <br />DEFERRED 7/19/10. <br />ORDINANCE NO.: 49-10 BY: Antonio, Bullock, Butler, Madigan, <br />Powers, Smith, Summers. <br />AN ORDINANCE to amend Section 1501.04, Enforcement, of the Lakewood <br />Codified Ordinances, in order to authorize the issuance of misdemeanor citations for <br />violations of any provision of the Lakewood Fire Code by appropriate fire officials. <br />WHEREAS, there is currently no local authority for fire officials to issue <br />misdemeanor citations under the Lakewood Codified Ordinances; and <br />WHEREAS, granting such authority to those individuals within the Division of Fire <br />that are responsible for the enforcement of the code will make enforcement more <br />efficient; and <br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits <br />municipalities to exercise all .powers of local self-government and to adopt and enforce <br />within their limits such local police, sanitary and other similar regulations as are not in <br />conflict with general laws; now, therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1. That Section 1501.04, Enforcement, of the Lakewood Codified <br />Ordinances, currently reading as follows: <br />1501.04 ENFORCEMENT. <br />(a) No person shall serve as Municipal Fire Safety Inspector unless he has <br />received a certificate issued by the Ohio Superintendent of Public <br />Instruction under Ohio RC 3303,07 evidencing his satisfactory <br />completion of a fire safety inspection training program. <br />(b) The Municipal Fire Safety Inspector, upon examination or inspection, <br />shall issue citations when he fords conditions as specified in Ohio R.C. <br />3737.41 which are especially dangerous to the safety of persons, <br />buildings, premises or property, and shall make any necessary remedial <br />orders in connection therewith Citation enforcement may be by use of <br />the procedures established by Ohio R.C.. 3737.42 for hearing on the <br />citation or Ohio R. C. 3737.44 for injunctive relief or temporary <br />restraining order and oral order for vacation of the building or <br />premises. <br />(c) The Municipal Fire Safety Inspector, upon reasonable belief and after <br />inspection or investigation, shall with reasonable promptness issue a <br />
