PLACED ON 1~ READING & REFERRED TO THE <br />PUBLIC WORKS COMMITTEE 7/6/10. <br />ORDINANCE N0. 50-10 BY: Antonio, Bullock, Butler, Madigan, <br />Powers, Smith, Summers. <br />AN ORDINANCE to take effect immediately provided it receives the affirmative <br />vote of at least five (5) members elected to Council otherwise, it shall take effect and <br />be in force after the earliest period allowed by law, authorizing the City of Lakewood to <br />participate in a the construction of traffic signals, radio interconnect and video detection <br />on Detroit Avenue in the City of Lakewood with the Ohio Department of Transportation. <br />WHEREAS, on March 16, 2009 the City of Lakewood enacted legislation <br />proposing cooperation with the Director of Transportation for the described project: <br />This project consists of the construction of traffic signals, radio <br />interconnect and video detection on Detroit Avenue, lying within the city <br />of Lakewood; and <br />WHEREAS, the City of Lakewood shall cooperate with the Director of <br />Transportation in the above described project as follows: <br />The City agrees to assume and bear one hundred percent (100%) of the entire <br />cost of the improvement, less the amount of Federal-aid Earmark and NOACA <br />funds set aside by the Director of Transportation for the financing of this <br />improvement from funds allocated by the Federal Highway Administration, U.S. <br />Department of Transportation, and further, the city agrees to assume and bear <br />one hundred percent (100%) of the cost of Preliminary engineering and Right-of- <br />Way, excluding in-house preliminary engineering and Right-of-Way charges <br />incurred by the State. <br />The share of the cost of the City of Lakewood is now estimated in the amount of Six <br />Hundred Forty Five Thousand Five Hundred Ninety Three and 20/100 Dollars, <br />($645,593.20) but said estimated amount is to be adjusted in order that the City of <br />Lakewood's ultimate share of said improvement shall correspond with said percentages <br />of actual costs when said actual costs are determined; and <br />WHEREAS, the Director of Transportation has approved said legislation proposing <br />cooperation and has caused to be made plans and specifications and an estimate of <br />cost and expense for improving the above described highway and has transmitted <br />copies of the same to the legislative authority; and <br />
