AN ORDINANCE to amend Chapter 1308, Flood Damage Prevention, of the Codified Ordinances of the City of Lakewood for the purpose of complying with the most current and up to date standazds and definitions relating to flood damage prevention, WHEREAS. Section 3 Article XVIII of the Constitution of the State of Ohio erants municipalities the authority to adopt land use and control measures for promoting the health safety and general welfare of its citizens; and WHEREAS pursuant to such authority and with the pumose of participatin¢ in the National Flood Insurance Program (NFIPI the City adopted its Flood Damage Prevention Code on January 16. 1978; and WHEREAS, the NFIP model code is periodically amended• and WHEREAS, the City's Flood Damage Prevention Code must remain in compliance with the NFIP model code in order to continue to participate in the NFIP• and WHEREAS suspension from the NFIP would prevent owners of flood- rn one property from securine flood insurance from the Federal Emergency Management A¢ency F( EMA) which administers the NFIP; Now Therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO Section 1. That Chapter 1308, Flood Damage Prevention, of the Codified Ordinances of the City of Lakewood, currently reading as follows: 1308.01 TITLE. The provisions of this chapter, hereinafter referred to as this "Code" shall be known as the Flood Damage Prevention Code of the City of Lakewood. 1308.02 FINDINGS OF FACT. (a) The flood hazard azeas of Lakewood aze subject to periodic inundation which may result in loss of life and property, health and safety hazazds, disruption of commerce and governmental services, extraordinary public expenditures for flood protection and relief, and impairment of the tax base, all of which adversely affect the public health, safety and general welfaze.
