SUBSTITUTE for ORDINANCE N0. 57-10 PLACED ON 1ST <br />READING & REFERRED TO THE PUBLIC WORKS COMMITTEE <br />7/19/10, 2ND READING 9/8/10, DEFERRED 10/4/10. <br />J J~v <br />ORDINACENO. 57-10 BY• Antonio, Bullock., Butler, <br />Madigan, Powers, Smith; Summers. <br />AN ORDINANCE to amend Chapter 1308, Flood Damage Prevention, of the Codified <br />Ordinances of the City of Lakewood for the purpose of complying with the most current and up <br />to date standazds and definitions relating to flood damage prevention, <br />WHEREAS. Section 3 Article XVIII of the Constitution of the State of Ohio erants <br />municipalities the authority to adopt land use and control measures for promoting the health <br />safety and general welfare of its citizens; and <br />WHEREAS pursuant to such authority and with the pumose of participatin¢ in the <br />National Flood Insurance Program (NFIPI the City adopted its Flood Damage Prevention Code <br />on January 16. 1978; and <br />WHEREAS, the NFIP model code is periodically amended• and <br />WHEREAS, the City's Flood Damage Prevention Code must remain in compliance with <br />the NFIP model code in order to continue to participate in the NFIP• and <br />WHEREAS suspension from the NFIP would prevent owners of flood- rn one property <br />from securine flood insurance from the Federal Emergency Management A¢ency F( EMA) <br />which administers the NFIP; <br />Now Therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br />Section 1. That Chapter 1308, Flood Damage Prevention, of the Codified <br />Ordinances of the City of Lakewood, currently reading as follows: <br />1308.01 TITLE. <br />The provisions of this chapter, hereinafter referred to as this "Code" shall be known as the <br />Flood Damage Prevention Code of the City of Lakewood. <br />1308.02 FINDINGS OF FACT. <br />(a) The flood hazard azeas of Lakewood aze subject to periodic inundation which may <br />result in loss of life and property, health and safety hazazds, disruption of commerce and <br />governmental services, extraordinary public expenditures for flood protection and relief, and <br />impairment of the tax base, all of which adversely affect the public health, safety and general <br />welfaze. <br />(b) These flood losses are caused by the cumulative effect of obstructions in areas of <br />special flood hazards which increase flood heights and velocities and, when inadequately <br />
