PLEASE SUBSTITUTE FOR ORDINANCE 4-ll <br />PLACED ON 1ST READING:& REFERRED TO THE <br />PUBLIC SAFETY COMMITTEE 2/7/11, 2ND READING <br />2/22/11, <br />ORDINANCE NO. 4-11 BY: Anderson, Bullock, Juris, Madigan, <br />Nowlin, Powers, Smith. <br />AN ORDINANCE to take effect immediately provided it received the affirmative <br />vote of at least five (5) members of Council, or otherwise to take effect and be in force <br />after the earliest period allowed by law, to amend Chapter 741 of the Codified Ordi- <br />nances, Peddlers, Vendors and Solicitors, in order to strengthen the background checks <br />that are performed for applicants seeking a license, to prohibit solicitation and peddling <br />after dark, further define crimes which would disqualify an individual from licensing and <br />to provide a "Do Not Knock Registry" for residents to notify peddlers and solicitors that <br />they do not. want such activity at their residence. <br />WHEREAS, the City of Lakewood has an interest in the safety and security of its <br />residents while in their homes; and <br />WHEREAS, multiple complaints have been lodged over the past year regarding <br />inappropriate behavior of solicitors and instances where residents felt uncomfortable in <br />their homes after dark while interacting with solicitors; and <br />WHEREAS, changes to the existing code provisions are necessary to directly ad- <br />dress these issues;and <br />WHEREAS, this Council by a vote of at least five (5) of its members determines <br />that this ordinance is an emergency measure; and that this ordinance shall take effect at <br />the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the SEC- <br />OND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary <br />for the immediate preservation of the public property, health and safety, and to provide <br />for the usual daily operation of municipal departments in that traditionally, as the weather <br />warms, the City of Lakewood notes a higher rate of soliciting and applications for Solici- <br />tor's Permits. Now, therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1. That Chapter 741, Peddlers, Vendor and Solicitors of the codified <br />Ordinances of the City of Lakewood, currently reading as follows: <br />741.01 DEFINITIONS. <br />(a) "Canvassing" or "soliciting," unless expressly pro- <br />vided for otherwise, means traveling from residence <br />to residence within the Municipality, without hav- <br />ing aprevious appointment to visit the residence or <br />
