Please substi <br />original. <br />and referred <br />Whole <br />10/1/12. <br />for adoption <br />:ute for the <br />ORDINANCE NO. 43-12 BY: Anderson, Bullock, Juris, <br />Madigan, Nowlin, Powers, Smith. <br />AN ORDINANCE amending Section 1325.08, Parking Design, of the Codified <br />Ordinances of the City of Lakewood to establish regulations for the maintenance and de- <br />sign of vacant and unimproved properties. <br />WHEREAS, Section 1325.08 of the Lakewood Codified Ordinances guides prop- <br />erty owners constructing parking lots on appropriate lot design; and <br />WHEREAS, Section 1325.08 makes parking lot design approval a function of the <br />Board of Building Standards and Architectural Board of Review; and <br />WHEREAS, other than laws of general applicability, owners of vacant, unim- <br />proved lands in the City do not benefit from the same guidance or review process; and <br />WHEREAS, when owners of vacant and unimproved properties fail to maintain <br />and manage the properties actively, those properties can become a major cause of blight <br />in both residential and nonresidential neighborhoods; and <br />WHEREAS, vacant and unimproved properties that are overgrown, littered upon, <br />substandard, or unkempt discourage economic development and retard appreciation of <br />property values; and <br />WHEREAS, it is a responsibility of property ownership to prevent owned proper- <br />ty from becoming a burden to the neighborhood and community and a threat to the public <br />health, safety and welfare; and <br />WHEREAS, the code therefore stands to be amended in order to provide for lot <br />design guidelines and a review process for owners of vacant, unimproved lands; and <br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits <br />municipalities to exercise all powers of local self - government and to adopt and enforce <br />within their limits such as local police, sanitary and other regulations as are not in conflict <br />with general laws; and <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />
