PLACED ON FIRST READING & REFERRED ~ <br />TO TAE PUBLIC <br />10/15/12. <br />SECOND READING <br />SAFETY COA7MITTEE <br />11/5/12. <br />ORDINANCE NO. 53-12 BY; Anderson, Bullock, Juris, Madigan, <br />Nowlin, Powers, Smith. <br />rAN ORDINANCE to take effect immediately provided it receives the affirmative vote of <br />at least live (5) members of Council, or otherwise to take effect at the earliest period allowed by <br />lava, amending Section 331.12, "U" 'Earns Restricted, of the Codified Ordinances of the City of <br />T,akewaod for the purpose of complying with changes to the State of Ohio traffic code. <br />WHEREAS, the following change has recentl}+ been made to the State of Ohio traffic <br />code: and <br />.WHEREAS, Article 18, Section 3 of the Constihrtion of the State of Ohio permits nm- <br />nicipalities to exercise all powers of local sell=government and to adopt and enforce vvithiu their <br />limits such as local police, sanitary and other regulations as are not in ealiliet with general laws; <br />and <br />WIiEREAS, this Council by a vote of at least five (5} of its members determines that this <br />ordinance is an emergency measure and that it shall take effect at the earliest date possible as set <br />Corth in Article lll, Sections 10 aad 13 of the Second Amended Charter of the City of Lakewood <br />and that it is necessary for the inuuecliate preservation of the public property, health, and safety <br />and to provide for the usual Bail}+ operation of nuu~icipal departments in that the City ~~+ishes to <br />close any window of time between the effective date of the state code change and the effective <br />date of the local code change; now, therefore, <br />BE 1'f ORDAINED BY THE CITY Ol^ LAKEWOOD, STATE OF OHIO: <br />SECTION 1. Section 331.12, "U" Turns Restricted, currently reading as follows: <br />SECTION 33 L 12 "i7" TURNS RESTRICTED <br />(a) Except as provided is subsection (b) hereof, no vehicle shall be <br />turned so as to proceed iu the opposite direction upon any curve, or <br />upon the approach to or near the crest of a grade, if the vehicle <br />oaanot be scea within 500 feet by the driver of any other vehicle <br />approaching from either directioD. <br />(b) The driver of an emergency vehicle ar public safety vehicle, when <br />responding to an emergency call, may turn the vehicle so as to pro- <br />ceed in the opposite direction. This subsection applies only when <br />the emergency vehicle or public safety vehicle is responding to an <br />emergency call, is equipped with and displaying at least one flash- <br />ing, rotating or oscillating light visible under normal atmospheric <br />conditions from a distance of 500 feet to the fi•out of the vehicle, <br />and when the driver of the vehicle is giving an audible signal by si- <br />ren, exhaust whistle or bell This subsection does not relieve the <br />driver of an emergency vehicle or public safety vehicle fi•om the <br />
