PLACED ON FIRST READING & <br />REFERRED TO THE PUBLIC SAFETY <br />COMMITTEE 10/15/12. <br />SECOND READING 11/5/12. <br />ORDINANCE NO. 58-12 BZ'~ Anderson, Bullock, Juris, <br />Madigan, Nowlin, Powers, Smith. <br />AN ORDINANCE to take effect inuuediately provided it receives the affirmative vote of <br />at least five (5} members of Council, or otherwise to take effect at the earliest period allowed by <br />law, amending Section 335.072, Driving Under Financial Responsibility Law Suspension or <br />Cancellation; amending Section 335.073, Driving Without Complying with License Reinstate- <br />ment Requirements; amending Section 335.12, Stopping After Accident Upon Streets; amending <br />Section 335.13, Stopping After Accident Upon Property Other Thau Streets; and amending Sec- <br />tion 335.14, Vehicle Accident Resulting in Damage to Realty, of the Codified Ordinances of the <br />City of Lakewood to reflect recent changes iu the State traffic code. <br />WHEREAS, the following changes have recently been made the State of Ohio traffic <br />code; and <br />4~~HEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits ruu- <br />nicipalities to exercise all powers of local self-government and to adopt and enforce within their <br />limits such as local police, sanitary and other regulations as are not in conflict with general laws; <br />and <br />WI IEREAS; this Council by a vote of at least five (5) of its members determines that this <br />ordinance is an emergency measure and that it shall take effect at the earliest date possible as set <br />forth in Article III, Sections ] 0 and 13 of the Second Amended Charter of the City of Lakewood <br />and that it is necessary for the immediate preservation of the public property, health, and safety <br />and to provide for the usual dail}~ operation of municipal departments in that the City wishes to <br />close any window of time between the effective date of the state code change and the effective <br />date of the local code change; now, therefore, <br />BE ff ORDAINED BY "fHE CITY OP LAKEWOOD, STATE OF OHIO: <br />SEC'f10N 1. Section 335.072 Driving Under Financial Responsibility Law Suspension or <br />Cancellation, currently reading as follows: <br />335.072 DRIVING UNDER FINANCIAL RESPONSIBILfI'Y LARD SUSPEN- <br />SION OR CANCELLATION. <br />(a) No person, whose driver's or commercial driver's license or temporary in- <br />struction permit or nonresidents operating privilege has been suspended or <br />canceled pursuant to Ohio R.C. Chapter 4509, shall operate any motor ve- <br />hicle within this Municipality, or knowingly permit any motor vehicle <br />owned by the person to be operated by another person in the Municipality, <br />during the period of the suspension or cancellation, except as specifically <br />authorized by Ohio R.C. Chapter 4509. No person shall operate a motor <br />vehicle within this Municipality, or knowingly permit any motor vehicle <br />owned by the person to be operated by another person in the Nfuuicipality, <br />
