AN ORDINANCE to take effect inuuediately provided it receives the affirmative vote of at least five (5} members of Council, or otherwise to take effect at the earliest period allowed by law, amending Section 335.072, Driving Under Financial Responsibility Law Suspension or Cancellation; amending Section 335.073, Driving Without Complying with License Reinstate- ment Requirements; amending Section 335.12, Stopping After Accident Upon Streets; amending Section 335.13, Stopping After Accident Upon Property Other Thau Streets; and amending Sec- tion 335.14, Vehicle Accident Resulting in Damage to Realty, of the Codified Ordinances of the City of Lakewood to reflect recent changes iu the State traffic code. WHEREAS, the following changes have recently been made the State of Ohio traffic code; and 4~~HEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits ruu- nicipalities to exercise all powers of local self-government and to adopt and enforce within their limits such as local police, sanitary and other regulations as are not in conflict with general laws; and WI IEREAS; this Council by a vote of at least five (5) of its members determines that this ordinance is an emergency measure and that it shall take effect at the earliest date possible as set forth in Article III, Sections ] 0 and 13 of the Second Amended Charter of the City of Lakewood and that it is necessary for the immediate preservation of the public property, health, and safety and to provide for the usual dail}~ operation of municipal departments in that the City wishes to close any window of time between the effective date of the state code change and the effective date of the local code change; now, therefore, BE ff ORDAINED BY "fHE CITY OP LAKEWOOD, STATE OF OHIO: SEC'f10N 1. Section 335.072 Driving Under Financial Responsibility Law Suspension or Cancellation, currently reading as follows: 335.072 DRIVING UNDER FINANCIAL RESPONSIBILfI'Y LARD SUSPEN- SION OR CANCELLATION. (a) No person, whose driver's or commercial driver's license or temporary in- struction permit or nonresidents operating privilege has been suspended or canceled pursuant to Ohio R.C. Chapter 4509, shall operate any motor ve- hicle within this Municipality, or knowingly permit any motor vehicle owned by the person to be operated by another person in the Municipality, during the period of the suspension or cancellation, except as specifically authorized by Ohio R.C.
