PLACED ON 1ST READING & REFERRED TO <br />THE PUBLIC WORKS COMMITTEE 6/3/13. <br />PLACED ON 2ND READING 6/17/13. <br />ORMNANCENO. 16 -13 BY: Anderson, Bullock, Juris, <br />Madigan, Nowlin, Powers, <br />AN ORDINANCE amending Section 905.07, Animals, and Section 905.98, Au- <br />thority of the Director of Public Works, of the Lakewood Codified Ordinances, to clarify <br />certain rules governing use of the parks within the Code. <br />WHEREAS, Chapter 905 of the Code stands to be amended to clarify -,,,,here ani- <br />mals may be taken in the parks and to give legal effect to the authority of the Director of <br />Public Works in posting additional rules and regulations; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Re- <br />vised Code, municipalities have the power of local self - government; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Re- <br />vised Code, municipalities have the power to enact laws that are for the health, safety, <br />welfare, comfort and peace of the citizens of the municipality; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Section 905.07, Animals, of the Lakewood Codified Ordinances, cur- <br />rently reading as follows: <br />905.07 ANIMALS. <br />(a) Animals Prohibited. No dogs or other animals shall be allowed <br />within the parks, with the exception of those animals specifically <br />authorized by the Director of Public Works or by ordinance. <br />(b) Feeding of Animals Prohibited. No person shall feed or otherwise <br />provide food to geese, other wild animals and/or birds within the <br />parks. <br />(c) Molesting Animals. No person shall use any weapon, stick, stone <br />or missile of any kind in the destruction or injury of or to, or in <br />such manner as to disturb or molest, any wild or domestic fowl, an- <br />imal or fish properly within the park limits. <br />(d) If dogs are permitted within any park pursuant to subsection (a) <br />hereof, no person shall fail to adhere to the following rules and re- <br />strictions: <br />(1) Any dog must be on a leash that is extended no farther than six <br />feet and must wear a collar or harness that must be specifically <br />made or manufactured to be the proper size and strength for <br />that particular dog. <br />
