ORDINANCE NO. 24 -13 PLACED ON 1ST READING & REFERRED TO THE PUBLIC SAFETY COMMITTEE 7/15/13. SECOND READING 9/3/13. BY: Anderson, Bullock, Suris, Madigan, Nowlin, Powers. AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at least five members of Council, or otherwise to take effect and be in force after the earliest pe- riod allowed by law, authorizing and directing the Mayor to enter into a memorandum of under- standing and lease agreement for a single boat dock located in the Clifton Lagoon with the Trus- tees of Clifton Lagoon and the Trustees of Clifton Park Trust pursuant to Section 155.08 of the Codified Ordinances. WHEREAS, the Division of Fire purchased a boat for response and rescue efforts on the water; and WHEREAS, entering into a lease to dock the boat in the Clifton Lagoon will allow the Division of Fire to increase response times to water related emergencies; and WHEREAS, the City will spend no money under the boat dock lease; and WHEREAS, this Council has determined it is in the best interest of the City to enter into a lease relationship with the Trustees of Clifton Lagoon and the Trustees of Clifton Park Trust to further the interest of the City and its residents; and WHERAS, this Council by a vote of at least five of its members determines that this or- dinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal department in that the season for water - related emergencies is already underway; now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: Section 1. The Mayor is hereby authorized and directed, on behalf of the City, to enter in- to a memorandum of understanding and a lease for a single boat dock located in the Clifton La- goon with the Trustees of Clifton Lagoon and the Trustees of Clifton Park Trust pursuant to Sec- tion 155.08 of the Codified Ordinances, with the City spending no money under the lease. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements.
