ORDINANCE NO. 29-13 BY: Anderson, Bullock, Juris, Madigan, Nowlin, Powers, Smith. AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at least five members of Council, or otherwise to take effect and be in force after the earliest period allowed by law, amending Section 557.04, Permit and Application, of the Codified Ordinances of the City of Lakewood to allow the Director of Public Safety to set the deadline for special event permit applications. WHEREAS, the administration is attempting to better manage assets necessary to support special events within the City of Lakewood; and WHEREAS, currently the ordinance provides a minimum 45 -day application period; and WHEREAS, the City can better schedule resources to support such events and ensure that resources necessary for the operation of the City of Lakewood are not diverted from City operations if the application period can be modified as necessary; and WHEREAS, this Council by a vote of at least five of its members determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood, and that it is necessary for the immediate preservation of the public peace, property, health and safety, and to provide for the usual daily operation of municipal departments, in that this application deadline should be modified to allow as much notice as possible to returning event coordinators; now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: Section 1. Section 557.04, Permit and Application, of the Codified Ordinances of the City of Lakewood, currently reading as follows: 557.04 PERMIT AND APPLICATION. (a) Except for parades or special events sponsored by the City including, but not limited to, holiday parades, block parties, commemorations, social gatherings, tours and similar events, no person or organization shall sponsor or conduct a parade or special event without fast obtaining a permit from the Director of Public Safety or his or her designee. The application for such a permit shall be filed with the Director or designee not less than 45 days prior to the parade or special event, and shall contain such information required by the Director. (b) The Director of Public Safety or his or her designee shall forward the application to the Director of Public Works for review and comment on the proposed route or special event.
