<br />AN ORDINANCE amending Section 905.14, Dogs with Blind, Deaf or Mobility
<br />Impaired Persons, of the Lakewood Codified Ordinances, to make it consistent with a
<br />similar provision within the Ohio Revised Code and remove conflicts with the Americans
<br />with Disabilities Act (ADA).
<br />WHEREAS, Section 905.14, Dogs with Blind, Deaf or Mobility Impaired Persons
<br />currently requires that an individual requiring the assistance of the animals covered by
<br />the ordinance provide documentation or certification of the animal's training; and
<br />WHEREAS, operators of places of public accommodation are very limited by the
<br />ADA as to what information can be required of an individual who requires the assistance
<br />of an animal; and
<br />WHEREAS, in order to ensure that there is no conflict between the City of Lake-
<br />wood Codified Ordinances and the ADA, this section must be amended; and
<br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Re-
<br />vised Code, municipalities have the power of local self - government; and
<br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Re-
<br />vised Code, municipalities have the power to enact laws that are for the health, safety,
<br />welfare, comfort and peace of the citizens of the municipality; now, therefore
<br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO:
<br />Section 1. Section 905.14, Dogs with Blind, Deaf or Mobility Impaired Persons,
<br />of the Lakewood Codified Ordinances, currently reading as follows:
<br />505.14 DOGS WITH BLIND, DEAF OR MOBILITY IMPAIRED
<br />PERSONS.
<br />(a) When a blind, deaf or mobility impaired person is accompanied by
<br />a dog that serves as, or is in training to become, a guide, leader, lis-
<br />tener or support dog for him or her, and he or she can show proof
<br />by certificate or other means that the dog leading him or her, lis-
<br />tening for him or her, or providing support or assistance for him or
<br />her, has been or is being trained for that purpose by a nonprofit
<br />special agency engaged in such work, the person is entitled to the
<br />fidl and equal accommodations, advantages, facilities and privileg-
<br />es of all public conveyances, hotels and lodging places, all places
<br />of public accommodation, amusement or resort, all institutions of
<br />education, and other places to which the general public is invited,
<br />and may take the dog into such conveyances and places, subject
