ORDINANCE NO. 18 -14 BY: Anderson, Bullock, Juris, Madigan, Marx, Nowlin, O'Leary. AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at least five members of Council, or otherwise to take effect at the earliest period allowed by law, enacting Chapter 148, Personal Information Systems, of the Codified Ordinances of the City of Lakewood in order to comply with the Ohio Personal Information Systems Act. WHEREAS, the Ohio Personal Information Systems Act, codified in Ohio Revised Code Chapter 1347, requires municipalities to adopt rules governing the protection of confidential per- sonal information; and WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits munic- ipalities to exercise all powers of local self - government and to adopt and enforce within their limits such as local police, sanitary and other regulations as are not in conflict with general laws; and WHEREAS, this Council by a vote of at least five of its members determines that this or- dinance is an emergency measure and that it shall take effect immediately, as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood, and that it is necessary for the immediate preservation of the public property, health, and safety and to provide for the usual daily operation of municipal departments, in that the City must adopt a personal in- formation systems policy by mandate of the Ohio Revised Code; now, therefore BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: Section 1. Chapter 148, Personal Information Systems, of the Codified Ordinances of the City of Lakewood shall be and is hereby enacted to read as follows: CHAPTER 148 Personal Information Systems 148.01 DEFINITIONS. As used in this chapter: (a) "Personal information," "maintains" and "system" shall have the same meaning as in Ohio Revised Code Section 1347.01. (b) "City official' means the Mayor, the chief of the Division of Police, the chief of the Division of Fire, and the directors of the various departments of the City. (c) "Personal information system officer" means an individual who has been appointed pursuant to Section 148.04.
