Placed on first reading and referred to <br />the Rules and Ordinances Committee April <br />7, 2014, second reading April 21, 2014. <br />Recommended for adoption May 27, 2014. <br />Please substitute for the original. <br />ORDINANCE NO. 18 -14 BY: Anderson, Bullock, Juris, <br />Madigan, Marx, Nowlin, O'Leary. <br />AN ORDINANCE to take effect immediately provided it receives the affirmative vote of <br />at least five members of Council, or otherwise to take effect at the earliest period allowed by law, <br />enacting Chapter 148, Personal Information Systems, of the Codified Ordinances of the City of <br />Lakewood in order to comply with the Ohio Personal Information Systems Act. <br />WHEREAS, the Ohio Personal Information Systems Act, codified in Ohio Revised Code <br />Chapter 1347, requires municipalities to adopt rules governing the protection of confidential per- <br />sonal information; and <br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits munic- <br />ipalities to exercise all powers of local self - government and to adopt and enforce within their <br />limits such as local police, sanitary and other regulations as are not in conflict with general laws; <br />and <br />WHEREAS, this Council by a vote of at least five of its members determines that this or- <br />dinance is an emergency measure and that it shall take effect immediately, as set forth in Article <br />III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood, and that it is <br />necessary for the immediate preservation of the public property, health, and safety and to provide <br />for the usual daily operation of municipal departments, in that the City must adopt a personal in- <br />formation systems policy by mandate of the Ohio Revised Code; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Chapter 148, Personal Information Systems, of the Codified Ordinances of the <br />City of Lakewood shall be and is hereby enacted to read as follows: <br />CHAPTER 148 <br />Personal Information Systems <br />148.01 DEFINITIONS. <br />As used in this chapter: <br />(a) "Personal information," "maintains" and "system" shall have the same <br />meaning as in Ohio Revised Code Section 1347.01. <br />(b) "City official' means the Mayor, the chief of the Division of Police, the <br />chief of the Division of Fire, and the directors of the various departments of <br />the City. <br />(c) "Personal information system officer" means an individual who has been <br />appointed pursuant to Section 148.04. <br />
