<br />AN ORDINANCE amending Section 905.09, Billposting; Permit for Erecting
<br />Structures or Decorations, of the Codified Ordinances of the City of Lakewood to author-
<br />ize volunteer participation in a public education program of identifying tree species tags
<br />on public trees.
<br />WHEREAS, healthy, mature, and safe trees are beneficial to property values, air
<br />quality, storm water management, energy use reduction, and the beautification of our
<br />City; and
<br />WHEREAS, a tree identification public education program can benefit tree care in
<br />the City by raising awareness about the value of and proper care techniques for trees; and
<br />WHEREAS, the Lakewood Tree Task Force recommended tree management pol-
<br />icy changes to this effect; and
<br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits
<br />municipalities to exercise all powers of local self - government and to adopt and enforce
<br />within their limits such as local police, sanitary and other regulations as are not in conflict
<br />with general laws; now, therefore,
<br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO:
<br />Section 1. Section 905.09, Billposting; Permit for Erecting Structures or Decora-
<br />tions, of the Codified Ordinances of the City of Lakewood, currently reading as follows:
<br />905.09 BILLPOSTING; PERMIT FOR ERECTING STRUC-
<br />TURES OR DECORATIONS.
<br />No person, except City employees or contractors in the performance of
<br />City work, shall erect any structure, sign, bulletin board, post, pole or
<br />advertising device of any kind whatsoever within the parks, nor shall
<br />any person attach any advertisement, notice, bill, poster, sign, wire, rod
<br />or cord to any tree, shrub, fence, railing, fountain, post, vase, statue,
<br />bridge or other monument or structure in any park. However, the Direc-
<br />tor of Public Works may grant a permit for the erection of temporary
<br />decorations and structures on the occasion of public celebrations or hol-
<br />idays or other general public meetings.
