Please <br />substitute for the original. <br />ORDINANCE NO. 28 -14 BY: Anderson, Bullock, Juris, <br />Madigan, Marx, Nowlin, O'Leary. <br />AN ORDINANCE to amend Chapter 1339, Storm Water Management, of the Codified <br />Ordinances of the City of Lakewood to update it in accordance with the model code of the Envi- <br />ronmental Protection Agency. <br />WHEREAS, it is necessary and desirable to amend the Building Code of the City to <br />amend provisions for storm water management; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Revised <br />Code, municipalities have the power of local self - government, and the power to enact laws that <br />are for the health, safety, welfare, comfort and peace of the citizens of the municipality; and <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Chapter 1339, Storm Water Management, of the Codified Ordinances of the <br />City of Lakewood, currently reading as follows: <br />Chapter 1339. Storm Water Management <br />I R U 91 11 M <br />(a) The intent of this chapter is to establish technically feasible and economical- <br />ly reasonable standards to achieve a level of storm water management, and ero- <br />sion and sediment control that will minimize damage to public and private prop- <br />erty and degradation of water resources, and will promote and maintain the <br />health, safety, and welfare of the residents of the City of Lakewood. The stand- <br />ards, or Best Management Practices (BMP), referred to and required by this <br />chapter shall be in accordance with the current version of the Ohio Rainwater <br />and Land Development Manual promulgated by the Ohio Department of Natural <br />Resources. <br />(b) This chapter applies to all parcels and projects located within the City of <br />Lakewood that disturb an area greater than 8,000 square feet regardless of public <br />sewer configuration in the project area, unless specifically exempted in Section <br />1339.01. <br />(c) This chapter does not require a Storm Water Management Plan for routine <br />public maintenance projects, such as sewer or watennain replacement or street <br />reconstruction, which does not result in the installation of additional impervious <br />surface and does not disturb more than 5 acres, as determined by the City Engi- <br />neer. <br />(d) This chapter requires owners who develop or re- develop their property with- <br />in the City of Lakewood to: <br />(1) Control the volume, rate and quality of storm water runoff from their prop- <br />erty to minimize the potential for downstream flooding, erosion, and sedimenta- <br />tion; <br />
