Substitute for Ordinance No. 15 — <br />16. 1" Reading and Referred to the <br />Rules and Ordinances Committee <br />2/1/2016, 2 "a Reading 2/16/2016, <br />Deferred 3/7/16. <br />ORDINANCE NO. 15 -16 BY: Anderson, Bullock, Litten, <br />Marx, O'Leary, O'Malley. <br />AN ORDINANCE amending Section 557.05, Fees of the Codified Ordinances of the City <br />of Lakewood to reflect that the application fee shall not be refundable as the City's actual costs <br />in accepting and processing any permit application along with the minimal services required for <br />any special event permit exceed the application fee. <br />WHEREAS, over time the administrative cost of processing an application has risen; and <br />WHEREAS, applications have to be reviewed by police, fire, public works and the <br />Mayor's office prior to approval; and <br />WHEREAS, nearly every permit requires minimal services such as the provision of <br />access to electrical outlets or placement of road blocks which requires the time of additional city <br />personnel and use of city equipment and vehicles; and <br />WHEREAS, the current provision implies that an applicant may be entitled to a refund of <br />a portion of the fee; and <br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits <br />municipalities to exercise all powers of local self- govertmlent and to adopt and enforce within <br />their limits such as local police, sanitary and other regulations as are not in conflict with general <br />laws; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. That Section 557.05, Fees, of the Lakewood Codified Ordinances, currently <br />reading as follows: <br />557.05 FEES. <br />Each permit application, except those submitted by the Lakewood Board of <br />Education, shall be accompanied by the application fee of three hundred dollars <br />($300.00) to reimburse the City for its administrative costs, including set -up and <br />inspections, the application fee shall be refunded only if no permit is <br />issued. After the parade or special event and all direct and indirect costs have <br />been calculated, the applicant will either be billed for or refunded the difference. <br />is hereby amended to read as follows: <br />557.05 FEES. <br />Each permit application, except those submitted by the Lakewood Board of <br />Education, shall be accompanied by the application fee of three hundred dollars <br />($300.00) to reimburse the City for its administrative costs, including set -up and <br />inspections„ tThe application fee may be waived by the Director of Public <br />
