READ 1ST 4/4/16 <br />SECOND READING 4/18/16. <br />ORDINANCE NO. 24 -16 BY: Anderson, Bullock, Litten, <br />Marx, O'Leary, O'Malley." <br />AN ORDINANCE to take effect immediately provided it receives the affirmative vote of <br />at least five members of Council, or otherwise to take effect and be in force after the earliest pe- <br />riod allowed by law, to amend Section 1133.09, Demolition or Removal of Residential Struc- <br />tures, of the Codified Ordinances of the City of Lakewood. <br />WHEREAS, currently, where a demolition permit is sought to remedy conditions imme- <br />diately dangerous to life, health or property, or to remedy a nuisance, a determination is required <br />that the demolition is necessary by the Director of the Division of Health in addition to the <br />Building Commissioner, Fire Chief and City Engineer; and <br />WHEREAS, this portion of the code was drafted when the city still had its own Division <br />of Health; and <br />WHEREAS, the city contracts with Cuyahoga County Public Health District for the pro- <br />vision of public health services and no longer has a Director of the Division of Health; and <br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits munic- <br />ipalities to exercise all powers of local self - government and to adopt and enforce within their <br />limits such as local police, sanitary and other regulations as are not in conflict with general laws; <br />and <br />WHEREAS, this Council by a vote of at least five of its members determines that this or- <br />dinance is an emergency measure, and that this ordinance shall take effect immediately, as set <br />forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood, <br />and that it is necessary for the immediate preservation of the public property, health and safety, <br />and to provide for the usual daily operation of municipal departments in that relevant provisions <br />of the zoning code to allow for the efficient issuance of demolition permits where the life, health <br />and safety are immediately at risk; now therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Section 1133.09, Demolition or Removal of Residential Structures, of the <br />Zoning Code within the Codified Ordinances of the City of Lakewood, currently reading as fol- <br />lows: <br />1133.09 DEMOLITION OR REMOVAL OF RESIDENTIAL STRUC- <br />TURES. <br />(a) Lakewood consists of very distinctive neighborhoods that were settled at <br />different times during its development each with its own distinctive housing <br />patterns, which are reflective of the time period during which these neigh- <br />borhoods were nurtured during the growth of the Cllr.
