Referred to Rules & Ordinances & Plan- <br />ning Commission 2/5/18; Second Reading <br />2/20/18; Recommended for Adoption by <br />Planning Commission 3/1/18 & Rules & Or- <br />dinances 6/4/18 <br />Anderson,Bullock,George,Littem <br />ORDINANCE NO. 6 -18 BY: O'Leary, O'Malley, Rader <br />AN ORDINANCE amending Section 1134.03, Procedures for Identification, Nomination <br />and Designation of an HPD or HP, of the Codified Ordinances of the City of Lakewood in order <br />to adjust the voting requirements of the Planning Commission based upon its new composition <br />under the Third Amended Charter. <br />WHEREAS, on November 7, 2017, the citizens of Lakewood adopted the proposed Third <br />Amended Charter of the City of Lakewood; and <br />WHEREAS, the Third Amended Charter provides for the composition of the Planning <br />Commission to be fixed at five members along with the city engineer serving ex officio in a non- <br />voting capacity, which is a reduction of two voting members from the commission's composition <br />under the Second Amended Charter; and <br />WHEREAS, this Council has determined that the ordinances must be updated to account <br />for this reduction, specifically with respect to the commission's voting requirements; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Revised <br />Code, municipalities have the power of local self - government; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Revised <br />Code, municipalities have the power to enact laws that are for the health, safety, welfare, comfort <br />and peace of the citizens of the municipality; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Subsection (k) of Section 1134.03, Procedures for Identification, Nomination <br />and Designation of an HPD or HP, of the Codified Ordinances of the City of Lakewood, cur- <br />rently reading as follows: <br />1134.03 PROCEDURES FOR IDENTIFICATION, NOMINATION AND <br />DESIGNATION OF AN HPD OR HP. <br />(k) The Commission shall determine whether said area, place, site, building(s), <br />public interior portions of a building, structure(s), works of art and other ob- <br />jects shall be designated as an HPD or HP. In the event the owner of a prop- <br />erty nominated as an HP, or each owner within a district nominated as an <br />HPD, does not consent to designation, the Commission may only designate <br />an HP or HPD by a vote of at least five of its members, or otherwise the <br />
