Read & Referred to Planning Commission <br />3/19/18; Second Reading 4/2/18; Referred <br />to COW 5/21/18; Recommended for <br />adoption by COW 6/11/18 <br />Anderson ,Bullock,George,Litten,O'Leary, <br />ORDINANCENO. 23 -18 BY: O'Malley, Rader <br />AN ORDINANCE to amend Section 1105.02 of the Zoning Code of the Codified <br />Ordinances of the City of Lakewood by changing and revising the Zoning Map of the City with <br />respect to certain property as set forth and described as 1381 Fry Avenue (PPN 312 -33 -054), <br />1379 Fry Avenue (PPN 312 -33 -053), and 1375 Fry Avenue (PPN 312 -33 -052) from C3 <br />(Commercial, General Business) to PD (Planned Development). <br />WHEREAS, it is desirable and necessary to rezone the property to allow for the <br />redevelopment of the property into townhomes; and <br />WHEREAS, the redevelopment meets the spirit and intent of the Planned Development <br />zoning chapter; and <br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits <br />municipalities to exercise all powers of local self - government and to adopt and enforce within <br />their limits such as local police, sanitary and other regulations as are not in conflict with general <br />laws; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Section 1105.02 of the Zoning Code of the Codified Ordinances of the City of <br />Lakewood be and the same is hereby amended by changing and revising the Zoning Map of the <br />City from C3 (Commercial, General Business District) to PD (Planned Development) for the <br />following property known as 1381 Fry Avenue (PPN 312 -33 -054), 1379 Fry Avenue (PPN 312- <br />33 -053), and 1375 Fry Avenue (PPN 312 -33 -052): <br />[See legal description and map attached hereto collectively as Exhibit A] <br />Section 2. The Director of Planning and Development is hereby authorized and directed <br />to make the reclassification change on the zoning map of the City of Lakewood, Ohio, in order to <br />reflect the amendment designated in Section 1 of this ordinance. <br />Section 3.
