Placed on 1st reading & referred to <br />Public Works 3/4/19; 2nd reading <br />3/18/19; deferred 4/1/19 <br />Anderson, Bullock, George, Litten, <br />O'Leary, O'Malley, Rader <br />ORDINANCE NO. 10 -19 BY: <br />AN ORDINANCE to take effect immediately provided it receives the affirmative vote of <br />at least two thirds of the members of Council, or otherwise to take effect and be in force after the <br />earliest period allowed by law, establishing rates of admission to the Lakewood municipal swim- <br />ming pools located at Lakewood Park and Madison Park, and superseding Ordinance 30 -09 and <br />all other ordinances inconsistent herewith. <br />WHEREAS, the cost of the operation of the municipal pools continues to increase, and an <br />increase on the admission charges is necessary to maintain the programs of the pool, and <br />WHEREAS, the City of Lakewood contributes to the pools by providing all supplies, <br />maintenance and maintenance personnel and will continue to do so; and <br />WHEREAS, pool rates have not increased since 2009; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this ordi- <br />nance is an emergency measure and that it shall take effect immediately, and that it is necessary <br />for the immediate preservation of the public property, health, and safety and to provide for the <br />usual daily operation of municipal departments in that revising pool rates will enable the recrea- <br />tion staff and city to prepare adequately for the 2019 swimming pool season; now, therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. The rates for admission to the Lakewood municipal swimming pools situated at <br />Lakewood Park and Madison Park are hereby established as shown in Exhibit A. <br />Section 2. For purposes of this ordinance "student" shall mean any person who during the <br />school semester immediately preceding the swimming sessions, was a student in kindergarten to <br />the twelfth grade, both inclusive. For the purpose of this ordinance, "adult" shall mean any per- <br />son, other than a student or a pre - kindergarten child. Children of pre- kindergarten age shall be <br />admitted free when accompanied by an adult, except for special programs. For the purposes of <br />this ordinance "senior citizen" shall mean any individual who is age 62 or over. <br />Section 3. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this ordinance were adopted in an open meeting of this Council, and <br />that all such deliberation of the Council and of any of its committees that resulted in such formal <br />action were in meetings open to the public in compliance with all legal requirements. <br />Section 4. This ordinance is hereby declared to be an emergency measure necessary for <br />the immediate preservation of the public peace, property, health, safety and welfare in the City <br />and for the usual daily operation of the City for the reasons set forth and defined in the preamble <br />
