~ ~ <br /> RESOLtT~ION No. 3223 bY' Tyler <br /> A RESOLUTION declaring it necessary and conducive to the public health, <br /> convenience and welfare to improve Cove Avenue from Clifton Botil.evard to the <br /> Nickel Plate Railroad, by resurfacing same with sheet asphalt or asphaltic concrote <br /> and doing any and all grading, draining and curbing or other work necessary thereto. <br /> BE IT RFSOLVz:.D BY TIC COUNCIL of THE CITY OF LA$P:47GCD, STAT$' OF OHIOa <br /> Section 1. That it is deemed and declared necessary to improve Cove Avenue <br /> from Clifton Boulevard to the Nickel Plate Railroads by resurfacing same with sheet <br /> asphalt or asphaltic concrete and doing any and all grading, draining and curbing or <br /> other Rork necessary thereto. <br /> Section 2. That the plans, specifications, estimates and profiles for <br /> said improvement, heretofore prepared by'Che Engineer and now nn file in the office of <br /> the Department of Public ?dorks, be and the same are hereby approved. <br /> Section 3. That the Entire cost and expense oS said improvement (less b2~% <br /> of same) shall be levied and assessed in proportion to the benefits which Rill ras~alt <br /> from said improvement upon the lots and lands bounding and abutting said improvement <br /> ors which'>gaid lots and lands are hereby determined to be specia7.].y benefitted by s aid <br /> improvement, and the cast and expense of the improvement shall include the expense of <br /> preliminary and other surveys printing_and publishing notices, resolutions and <br /> ordinances required, the serving of notices and the cost of construction, together <br /> r, Kith the 9.+iterest on bonds that shall be issued in anticipation of the collectiais tsf <br /> ~w <br /> deferred payments of assessments and other necessary and incidental expense. <br /> Section 1~. That the assessment so to be leviedshall be payable in five <br /> annum installments, Kith interest on deferred paymants at the rate of tRO per centum <br /> per annwn, payable semi-annually, provided ha~ever, that the o~rners of axi3* of said lots <br /> or parcels of land so assessed may, at their option, pay such assessment within <br /> thirty (30) days after the passage of the asse3sing ordinance in this proceeding, and <br /> such cash payment of assessments shall not include any items of interest on bonds to <br /> be issued in anticipation of the collection of deferred installments of assessments. <br /> Section 5. That bonds oY the City of Lakevrood shall be issued in anticipation <br /> the collection of said assessments in an amount equal thereto. <br /> Section 6. That the remainder of the entire cost and expense of said <br /> improveme~ not specially assessed, including the cost of intersections and damages <br /> awarded to any owner of adjoining lands or interest therein, shall be paid out of the <br /> Gasoline Tax or ~4otor Vehicle License Fnnds. <br /> Section 7.
