i _ `f° .J RESOLUTION N0. 3614 BY Mr. Quinn AN EMERGENCY RESOLUTION accepting the Instrument of Gift and the gift of properties as evidenced by such. instrument:, from the Donorsa all in form and manner as hereinafter set forth. WHEREAS, this resolution constitutes an emergency for the reams. sons that although the Instrument of Gift herein referred to was nmt delivered to the Director of Law until September 17~ 1954, it was executed as of June i$, 1954 requiring immediate action thereon in order to resolve the respeat~ve interests of the parties in the event of needed repair to such properties and thus provide for tho public welfare and safety and the usual daily operation of a municipal de- partment; nowt' therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD~ STATE_OF OHIO: Section 1. That the City of Lakewood does hereby accept from the hereinafter named Donors the Instrument of Gifts the gift evi» dented thereby and the properties described thereiny such Instrument of Gifts with signatures thereto omitted herein, reading as follows: uWHEREAS, the undersigned Donorsa each individually contributed on account oft' and together fully paid, the expense of all materials and for the installation, con» struction and erection of the hereinafter described Traffic Signal Lights as erected within and mver Berea Road for the control of traffic into, from and within Berea Road; and WHEREAS,. the Donors wish to be relieved from all ob» ligations in connection with said Traffic Signal Lights; now, thereforey The undersignedy Bigelow Sanford Carpet Companyy Howell Automatic Machine Companyy John Harsch Bronze and Foundry Company, Le Roi Companyy Ohio Carbon Companyy Precision Castings Company, Ramset Fasteners Ina. Straehle Machine Products Co,~ The DaXis Plywood Corp., The W. T, Walsh Equipment Companyy Variety Cabinet Company and White Sewing Machine Corporations herein rem (erred to as Donors, hereby giver assign., set over transfer and by this instrument aonstructiveiy delver to the City of Lakewood, a municipal corporation, the following described propertyy to•-wit; Four (4} Traffic Signal Lights within and over Berea Road one each being located in front of or near property within the City of Lakewood and numbered, respectively, 11~~0, 12500, 12502 and 12650 Berea Road, together with synchronizing cable and. other wires and all switches and accessories incidental and necessary to the installation and operation of said four (41 Traffic Signal Lights, It is understood by Donors that the gift evidenced by this instrument shall not be operative insofar as the City of Lakewood is or may be concerned unless and until a resolu» tion is adopted, and as so adopted becomes effective, by the Council of the City of Lakewood accepting this instru» ment and the gift of the properties hereinbefore described.
