RESOLUTION NO. 3800 BY: Messrso Fairgrieve, Gaydos, Gettermeyer, Quinn, Ward, Fahrenbacho A RESOLUTION deglaring the policy of this Counci~ with respect to the cost of resurfaczng a~d repaving streets in the Cmty of Lakewood, and hereby repealing Resolutmon Noo 3363. WHEREAS, A number of streets within the City of Lakewood re- quire immediate repair including resurfacing and repaving, by reason of which this Council has caused a survey of streets to be made by the Division of Engineering and the Commissioner of Streets, and WHEREAS, This Council intends from time to time to authorize the resurfacing and repaying of certain of said streets in such order as may be determined, and WHEREAS, The individual members of Council have given consider- able study and attention to the proper and equitable proportion ef cost to be paid by the City and property owners, respectively, and this Coun- cil desires to record its policy with respect thereto so as to avoid future misunderstanding as well as to obviate repetitious discussion, now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF 0HIO: Section 1. That the resurfacing and repaving of Detroit Avenue and Madison Avenue within the City of Lakewood shall be paid by the City in the manner herein set forth. Section 2. That the resurfacing and repaving of Lake Avenue, Clifton Boulevard, Franklin Boulevard, Hilliard Road, Athens Avenue, Delaware Avenue, Lakewood Heights Boulevard~ Highland Avenue, Warren Road, West Clifton Boulevard, Sloane Avenue, Riverside Drive and such other streets within the City of Lakewood which regularly serve as routes for motor bus vehicles engaged in public transportation, shall be paid for by the City in the manner herein set forth. Section 3. All other streets within the City of Lakewood~re- quiring resurfacing and repaying shall be paid by assessing fifty per- cent of the City's cost thereof, after first deducting the cost of intersections, against the owners of property abutting, abounding and especially benefited by such resurfacing and repaving; furthermore, said fifty percent of assessment is to mean that abutting property owners will be assessed twenty-five percent on eac~ side of the street so affected. Section ~. That in connection with the ~esurfacing and r~pav- ing of the streets mentioned in Section l, the Cmty shall pay 100% of the cost; that in connection with the resurfacing and repaving of the streets mentioned in Section 2, the City shall pay 100% of the cost; that in connection with the resurfacing and repaving of the streets in- cluded in Section 3, the City shall pay the remaining fifty percent of the cost. Section 5. That Council may vary the percentages above mentioned whenever in its judgment it concludes that a portion or all of the cost of such resurfacing or repaving of a street is attributed to the instal- lation of sewer, water or other utility furnished or supplied by the City of Lakewood, or other factors deemed by Council to justify devia- tion from above policies.
