RESOLUTION NO. <br /> <br />3800 BY: Messrso <br /> <br />Fairgrieve, Gaydos, <br />Gettermeyer, Quinn, <br />Ward, Fahrenbacho <br /> <br /> A RESOLUTION deglaring the policy of this Counci~ with respect <br />to the cost of resurfaczng a~d repaving streets in the Cmty of Lakewood, <br />and hereby repealing Resolutmon Noo 3363. <br /> <br /> WHEREAS, A number of streets within the City of Lakewood re- <br />quire immediate repair including resurfacing and repaving, by reason <br />of which this Council has caused a survey of streets to be made by the <br />Division of Engineering and the Commissioner of Streets, and <br /> <br /> WHEREAS, This Council intends from time to time to authorize <br />the resurfacing and repaying of certain of said streets in such order <br />as may be determined, and <br /> <br /> WHEREAS, The individual members of Council have given consider- <br />able study and attention to the proper and equitable proportion ef cost <br />to be paid by the City and property owners, respectively, and this Coun- <br />cil desires to record its policy with respect thereto so as to avoid <br />future misunderstanding as well as to obviate repetitious discussion, <br />now, therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF 0HIO: <br /> <br /> Section 1. That the resurfacing and repaving of Detroit Avenue <br />and Madison Avenue within the City of Lakewood shall be paid by the <br />City in the manner herein set forth. <br /> <br /> Section 2. That the resurfacing and repaving of Lake Avenue, <br />Clifton Boulevard, Franklin Boulevard, Hilliard Road, Athens Avenue, <br />Delaware Avenue, Lakewood Heights Boulevard~ Highland Avenue, Warren <br />Road, West Clifton Boulevard, Sloane Avenue, Riverside Drive and such <br />other streets within the City of Lakewood which regularly serve as <br />routes for motor bus vehicles engaged in public transportation, shall <br />be paid for by the City in the manner herein set forth. <br /> Section 3. All other streets within the City of Lakewood~re- <br />quiring resurfacing and repaying shall be paid by assessing fifty per- <br />cent of the City's cost thereof, after first deducting the cost of <br />intersections, against the owners of property abutting, abounding and <br />especially benefited by such resurfacing and repaving; furthermore, said <br />fifty percent of assessment is to mean that abutting property owners <br />will be assessed twenty-five percent on eac~ side of the street so <br />affected. <br /> <br /> Section ~. That in connection with the ~esurfacing and r~pav- <br />ing of the streets mentioned in Section l, the Cmty shall pay 100% of <br />the cost; that in connection with the resurfacing and repaving of the <br />streets mentioned in Section 2, the City shall pay 100% of the cost; <br />that in connection with the resurfacing and repaving of the streets in- <br />cluded in Section 3, the City shall pay the remaining fifty percent of <br />the cost. <br /> Section 5. That Council may vary the percentages above mentioned <br />whenever in its judgment it concludes that a portion or all of the cost <br />of such resurfacing or repaving of a street is attributed to the instal- <br />lation of sewer, water or other utility furnished or supplied by the <br />City of Lakewood, or other factors deemed by Council to justify devia- <br />tion from above policies. <br /> Section 6, That this resolution shall become the policy of <br /> <br /> <br />
