Gaydos, Gottermeyer, <br /> RESOLUTION NO. 4096 BY: Huffman, Lawther, <br /> Ward, Chockley. <br /> AN EMERGENCY RESOLUTION authorizing and directing the <br />Director of Public Works to complete.the necessary repairs and <br />reconstruction of the Winterhurst-Lakewood Municipal Skating <br />Rink by direct employment of labor and purchase of the necessary <br />supplies and materials and by contract without competitive <br />bidding. <br /> <br /> WHEREAS, The City of Lakewood has purchased the Winterhurst- <br />Lakewood Municipal Skating Rink, and, <br /> <br /> WHEREAS, It is deemed necessary by this Council that <br />certain repairs and reconstruction must be completed prior to <br />the opening of the said ice skating rink for use by the public <br />and, <br /> <br /> WHEREAS, In order that the said ice skating rink might be <br />maintained on a self-sustaining basis it is essential that the <br />said ice skating rink be open to the public by November 11, <br />1961, and, <br /> <br /> WHEREAS, Such opening date will not allow the time for <br />the usual drafting of the specifications and competitive bidding, <br />and, <br /> <br /> WHEREAS, This resolution constitutes an emergency measure <br />providing for the immediate preservation of the public property, <br />health and welfare and for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. Notwithstanding the provisions of Article V, <br />Section 3 of the Charter of the City of Lakewood, the Director <br />of Public Works be and he hereby is authorized to complete the <br />necessary repairs and reconstruction of the Winter. hurst-Lakewood <br />Municipal Skating Rink by direct employment of labor and <br />purchase of the necessary supplies and materials and by contract <br />without competitive bidding in accordance with plans on file in <br />the office of the Director of Public Works. <br /> <br /> Section 2. That this Council hereby determines that the <br />completion of the necessary repairs and reconstruction of the <br />Winterhust-Lakewood Municipal Skating Rink, without competitive <br />bidding, is an immediate necessity in order to preserve the <br />interests of the City. <br /> <br /> Section 3. That this resolution is hereby declared to be <br />an emergency measure for thereasons stated in the preamble hereof, <br />and provided it receives the affirmative vote of two-thirds of all <br />members elected to Council, it shall take effect and be in force <br />immediately upon its adoption and approval by the Mayor. <br /> <br />Adopted: November 6~ 1961 <br /> F.
