RESOLUTION NO. 4101 BY:Messrs. Gottermeyer, Huffman, <br /> Lawther, Ward, <br /> Williamson, Chockley, <br /> Gaydos. <br /> AN EF~ERGENCY RESOLUTION authorizing payment of a moral <br />claim in the amount of $132.70 to Robert M. and Rachel M. Lowe. <br /> <br /> WHEREAS, On November 3, 1961, a police cruiser collided <br />with and damaged a 1954 Oldsmobile sedan, owned by Robert M. and <br />Rachel M. Lowe, while the same was parked and unoccupied <br />in. the municipal parking lot at 12650 Detroit Avenue, Lakewood, <br />Ohio, and, <br /> <br /> WHEREAS, Under the provisions of Section 701.02 of the <br />Ohio RevisedCode, the City of Lakewood is not legally liable <br />for such damages, and, <br /> <br /> WHEREAS, This Council has determined that it has a moral <br />obligation to reimburse Robert M. and Rachel M. Lowe for said <br />damages, and, <br /> <br /> WHEREAS, This resolution constitutes an emergency <br />measure providing for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Director Of Finance be and he is <br />hereby authorized to pay to Robert M. and Rachel M. Lowe the <br />su~ of $132.70, for the cost of repair of damage to a 1954 <br />Oldsmobile sedan, inflicted by a police cruiser of the City of <br />Lakewood on November 3, 1961. <br /> <br /> Section 2. This resoiution is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof <br />and, provided it receives the affirmative vote of two-thirds of <br />all members elected to Council, it shall take effect and be in <br />force immediately upon its adoption and approval by the Mayor. <br /> <br />Adopted: Novembe~ 20, 196~ <br /> F.
