4159 - 62 Release portion of water main easement

RESOLUTION NO. ~199 BY: AN EMERGENCY RESOLUTION authorizing and directing the Director of Public Works to release a portion of a water main and appurtenance easement granted by the Wieber Realty Company, et al, to the City of Lakewood. WHEREAS, On November 2, 1926, the Wieber Realty Company, et al, granted to the City of Lakewood a water main and appurtenance easement located northerly of Lake Avenue and running northerly to a point 295 feet northerly of the proposed Edgewater Drive, and, WHEREAS, The portion of the easement is described as Parcel No. 2 and being that portion thirty (30) feet in width running northerly from the proposed Edgewater Drive 295 feet and located upon property owned by Winton Place, Inc., and, WHEREAS, Winton Place, Inc. has requested the City of Lakewood to release the portion of the said easement con- cerning Parcel No. 2, described hereinafter,and, WHEREAS, It has been determined that the portion of the said easement concerning Parcel No. 2 is no longer needed by the City of Lakewood for any municipal purpose, and, WHEREAS, This resolution constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Director of Public Works be and he is hereby authorized and directed to release a portion of a water main and appurtenance easement, dated November 2, 1926 and recorded in Volume 3926, page 529, of Cuyahoga County Records, said portion of the easement being further described as follows: "Situated in the City of Lakewood, County of Cuyahoga and State of Ohio, and known as being a part of Original Rockport Township Section No, 21, and being a strip of land 30 feet in width and a circle at the northerly end having a radius of 25 feet, 15 feet on either side of the following described line; Beginning on the northerly li~e of Lake'Avenue (I00 feet in width) at a point which Sears North 73° 41' West, along the said Northerly line of Lake Avenue, 183.21 feet from its point of intersection with the westerly line of land now owned by Martha E. Wieber.
