RESOLUTION NO. ~199 BY: <br /> <br /> AN EMERGENCY RESOLUTION authorizing and directing the <br />Director of Public Works to release a portion of a water main <br />and appurtenance easement granted by the Wieber Realty Company, <br />et al, to the City of Lakewood. <br /> <br /> WHEREAS, On November 2, 1926, the Wieber Realty <br />Company, et al, granted to the City of Lakewood a water main and <br />appurtenance easement located northerly of Lake Avenue and <br />running northerly to a point 295 feet northerly of the <br />proposed Edgewater Drive, and, <br /> <br /> WHEREAS, The portion of the easement is described as <br />Parcel No. 2 and being that portion thirty (30) feet in width <br />running northerly from the proposed Edgewater Drive 295 feet <br />and located upon property owned by Winton Place, Inc., and, <br /> <br /> WHEREAS, Winton Place, Inc. has requested the City <br />of Lakewood to release the portion of the said easement con- <br />cerning Parcel No. 2, described hereinafter,and, <br /> <br /> WHEREAS, It has been determined that the portion of the <br />said easement concerning Parcel No. 2 is no longer needed by <br />the City of Lakewood for any municipal purpose, and, <br /> <br /> WHEREAS, This resolution constitutes an emergency <br />measure providing for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Director of Public Works be and he <br />is hereby authorized and directed to release a portion of a <br />water main and appurtenance easement, dated November 2, 1926 and <br />recorded in Volume 3926, page 529, of Cuyahoga County Records, <br />said portion of the easement being further described as follows: <br /> <br />"Situated in the City of Lakewood, County of Cuyahoga and <br /> State of Ohio, and known as being a part of Original <br /> Rockport Township Section No, 21, and being a strip of <br /> land 30 feet in width and a circle at the northerly end <br /> having a radius of 25 feet, 15 feet on either side of the <br /> following described line; <br /> <br />Beginning on the northerly li~e of Lake'Avenue (I00 feet <br />in width) at a point which Sears North 73° 41' West, along <br />the said Northerly line of Lake Avenue, 183.21 feet from <br />its point of intersection with the westerly line of land <br />now owned by Martha E.
