AMENDED <br /> <br />RESOLUTION NO. 4179 BY: <br /> <br />Wendling~ Witliamson, <br />Gaydos, Huffman, <br /> Lawther, Usher, <br />Ward. <br /> <br /> AN EMERGENCY RESOLUTION declaring an emergency and auth- <br />orizing and directing the Director of Public Works to enter into <br />a contract without the statutory formalities of competitive bid- <br />ding and advertising, for the replacement of approximately 150 <br />to 200 feet of sanitary sewer and the relaying or replacement of <br />storm sewer where necessary in Riverside Drive. <br /> <br /> WHEREAS, A real and present emergency exists in that ap- <br />proximately 150 to 200 feet of sanitary sewer collapsed suddenly <br />in Riverside Drive thereby endangering the health and safety of <br />all of the citizens of the City of Lakewood, and, <br /> <br /> WHEREAS, The replacement of such sanitary sewer and the <br />relaying or replacement of storm sewer where necessary must be <br />made immediately in order to preserve the public health and <br />safety, and, <br /> <br /> WHEREAS, This resolution constitutes an emergency measure <br />providing for the immediate preservation of the public health <br />and safety and for the usual daily operation of a municipal de- <br />partment~ now, therefore~ <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Council hereby declares that the <br />sudden collapse of 150 to 200 feet of sanitary sewer in Riverside <br />Drive constitutes a real and present emergency. <br /> <br /> Section 2. That the Council hereby determines to make <br />the replacement of 150 to 200 feet of sanitary sewer and the re- <br />laying or replacement of storm sewer where necessary in Riverside <br />Drive by contrast. <br /> <br /> ~ Section 3. That the Director of Public Works be and he <br />is hereby authorized and directed to enter into a contract for <br />the replacement of approximately 150 to 200 feet of sanitary <br />sewer and the relaying or replacement of storm sewer where nec- <br />essary in Riverside Drive with the Kalill Company at an esti- <br />mated cost of not to exceed $50.00 per foot, without the necessity <br />of statutory and Charter formalities Of competitive bidding and <br />advertising. <br /> <br /> Section 4. This resolution is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof <br />and provided it receives the affirmative vote of two-thirds of <br />all members elected to Councils it shall take effect and be in <br />force immediately upon its adoption and approval by the Mayor. <br /> <br />Adopted: pctober 1~ 1962 <br /> <br />Approved: October 3, 1962 <br /> <br />Robert M.
