RESOLUTION NO. 4181 BY:Messrs. Lawther, Usher, <br /> Ward, Wendling, <br /> WIlliamson, Gaydos, <br /> Huffman. <br /> AN EMERGENCY RESOLUTION authorizing payment of a <br />moral claim in the amount of $246.25 to Philip J.and Evelyn R. <br />Peters, and The Aetna Casualty and Surety Company. <br /> <br /> WHEREAS, On July 25, 1962, a police cruiser collided <br />with and damaged a 1960 Dodge stationwagon, owned by Philip J. <br />and Evelyn R. Peters, while both vehicles were being operated <br />on Detroit Avenue in the vicinity of Bunts Road, Lakewood, Ohio, <br />and, <br /> <br /> WHEREAS, Under the provisions of a policy of insurance, <br />The Aetna Casualty and Surety Company assumed the costs of repair <br />in excess of $100.00 on such 1960 Dodge stationwagon, and, <br /> <br /> WHEREAS, Under the provisions of Section 701.02 of the <br />Ohio Revised Code, the City of Lakewood is not legally liable for <br />such damages, and, <br /> <br /> WHEREAS, This Council has determined that it has a <br />moral obligation to reimburse Philip J. and Evelyn R. Peters and <br />The Aetna Casualty and Surety Company for said damages, and, <br /> <br /> WHEREAS, This resolution constitutes an emergency <br />measure in that it provides for the usual daily operation of a <br />municipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Director of Finance be and he is <br />hereby authorized to pay to Philip J. and Evelyn R. Peters and The <br />Aetna Casualty and Surety Company, the sum of $246.25 for the costs <br />of repair of damage to a 1960 Dodge stationwagon, inflicted by <br />a police cruiser of the City of Lakewood on July 25, 1962. <br /> <br /> Section 2. That this resolution is hereby declared to <br />be an emergency measure for the reasons stated in the preamble <br />hereof and provided it receives the affirmative vote of two-thirds <br />of all members elected to Council, it shall t~(e effect and be in <br />force immediately upon its adoption and approval by the Mayor. <br /> <br />Adopted~...~vember 5~ 1962 <br /> Robert M.
