Messrs. Usher, Ward, RESOLUTION NO. 4280 BY: Wendting, Williamsen, Gaydos, Huffman, Lawther. AN EMERGENCY RESOLUTION authorizing and directing the Finance Director of the City of Lakewood to accept the principal and~interest on ~pecial assessment levied on permanent parcel numoer 313-19-174 on the Cuyahoga Oounty Auditor's records and authorizing the County Auditor to cancel said special assessment for the year 1964o WHEREAS, the City has special assessment charged against the property hereinafter described and levied under Ordinance No. 35-58, adopted by the Council of the City of Lakewood on July 7~ 1958, and, WHEREAS, The owner of the said property has tendered pay- ment of the principal portion and interest on the special assess- ment levied on said parcel pursuant to the provisions of Section 5719.16 of the Revised Code of the State of Ohio, and, WHEREAS, This resolution constitutes an~emergency measure providing for the usual daily operation of a municipal depart- ment~ now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD~ STATE OF 0HIO: Section t. That the Director of Finance of the City of Lakewood be and he is hereby authorized and directed to accept the sum of $18.46 tendered in payment of the principal and interest for the year 1964 of special assessment charged against the property described as permanent parcel number 313-19-174 on the Auditor's records of Cuyahoga County, Ohio, and levied under Ordinance No. 35-58, adopted by the Council of the City of Lakewood on July 7~ 1958. Section 2. That said special assessment as hereinbefore set forth having been accepted as set forth in Section 1 hereof, and the Auditor of Cuyahoga County be and he is hereby author- ized to cancel said special assessment for the year 1964 levied under Ordinance No. 35-58, adopted by the Council of the City of Lakewood on July 7, 1958 on permanent parcel number 313-19-174 on the County Auditor's records and further described as being Sublet number 131 in the Matthews & Gilbert Subdivision ~2~ each annual assessment being in the amount of $18.46. Section 3. That the Clerk of Council be and he is hereby ~uthorized and directed to deliver a certified copy of this resolution to the ~dl~or o£ ~.yaLo~a ~.o'~.~n'~ for i~e p~?pose of having said special assessment canceled. Section 4. That this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two- thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
