AN E~GENCY RE~OLUTION ~ecl~ring it necessary to improve Richland Avenue in the City of L~ewood by the necessary grading of the base, resurfacing with asphaltic concrete including the necessary replacoment and resetting of ca,tings ~nd the necessary resetting ~d replacing of curbs together with necessaA~Y appur- ter~uces thereto. WHEREAS~ this Council by t~*o~thirds vote of the r~embers elected thereto determines that this resolution is an emergency meas%Lre which is necessary for the i~ediate preservation of the public peace, property, health ~ud s~fety a~ for the further reason that the improvements herein provided are i~mediately necessar~ to eliminate existing hazards to vehicular ~traffic using the streets of this City$ NOW~ TNEREFC~E~ BE IT RESOLVED by the Council of the City of Lakewood, Cuyahoga County, State of Ohio, three-fourths of all members elected thereto concurring: Section 1. That it is necessary to improve in the City of Lakewood Richland Avenue from Madison Avenue to L~k~ood Heights Boulevard as set forth in ~ction 2 hereof~ Section 2. That said street shall be improved as shown on the plans herein- after referred to ~ud now on file i~ the office of'the Director of ~Public Works by the necessmry grayling of the b~se~ resurfacing with asphaltic concrete inclad- ing the necessmry replac~e~t and resetting of c~stings s~d resetting and replacing the c~J~bs together ~ith the 'neCessary appurten~uces thereto. Section ~. It is hereby d~ter~ined and dsclared that said improvement is conducive to the public health~ convenience ~nd welfare of said city and the inhabitants thereof. Section 4o That the grmde of s~id street as improved shall be the grade as sho~n~ by the pl.~us ~ud profiles which are made a part hereof. Section 5. That th~ plans~ specifications, esti~ates and profiles of the proposed improve~nt~ heretofore prepared az~d now on file in the office of the Director of Public Works, are hereby approved. Section 6. T~-nat 50% of the whole cost of said improvement sh~ll be assessed by the benefits upon the following ~scribed lots and l~uds, to wit~. ~_ll lots mud lands bouuding and ~butting Upon the proposed improvement between the termini aforesaid~ which said lots and lands are hereby determined to be specially benefited by said i~provement$ a~d the cost of said improvement s.h~ll include the cost of preliminary and other surveys, plans, specifications, profiles and estimates ~ud of printing, serving ~d publishing notices, resolu- tions and ordinances, the ~o~nt of ~ges resulting from the tmprove~aent sssessed in favor of a~y owner of land ~n~fected by the improvement aUd the interest thereon, the costs incurred in cor~ection with the preparation, levy and collection of the special assessments~ the cost of purchasing~ appropriating, and otherwise acquiring therefor any required real estate or interests therein, expenSes of legsl services including obtaining an ~pproving legal opinion~ cost of labor mud material and interest on bonds and. notes issued in anticilmation of the levy ~ud col&ection of the special assessments together with all other necessary expenditures.
