As .aj3~ended at special meeting <br />Aprzl 10, 1964. <br /> <br />RESOLUTION N0; ~.~338 <br /> <br />BY: MessrS. <br /> <br />Usher, Wendling, <br />Bennett, Cain, <br />Gaydos, Huffman. <br /> <br /> AN EMERGENCY RESOLUTION declaring an emergency and <br />authorizing and directing the Director of Public Works to enter <br />into a contract without the statutory formalities of competi- <br />tive bidding and advertising for furnishing and installing a new <br />visual vacuum filtering system at Lakewood Park Swimming Pool <br />Facility. <br /> <br /> WHEREAS, A real and present emergency exists in that <br />the water filter equipment at Lakewood Park Swimming Pool <br />Facility is inadequate and requires frequent and costly repairs, <br />and, <br /> <br /> WHEREAS, Said swimming pool facility is scheduled to <br />open to the public on June 8, 1964, and, <br /> <br /> WHEREAS, There is insufficient time to advertise for <br />bids and to complete such installation prior to said date of <br />June 8, 1964, and~ <br /> <br /> WHEREAS, The furnishing and installing of said new water <br />filtering system must be done immediately in order to preserve <br />the public health and safety, and, <br /> <br /> WHEREAS, This resolution constituDes an emergency meas- <br />ure providing for the immediate preservation of the public <br />health and safety and for the usual daily operation of a munici- <br />pal department; now~ therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Council hereby declares that the <br />need for a new water filtering system to replace the present in- <br />adequate system constitutes a real and present emergency <br /> <br /> Section 2. That the Council hereby determines to pro- <br />vide a new water filtering system at Lakewood Park Swimming Pool <br />facility by contract. <br /> <br /> Section 3. That the Director of Public Works be and he <br />is hereby authorized and directed to enter into a contract for <br />furnishing and installing a new visual vacuum water filtering <br />system and heati~E exchanger at Lakewood Park Swimming Pool <br />Facility, at a maximum cost of $21,165.00, without the necessity <br />of statutory and charter formalities of competitive bidding. <br />Provided, however, that the terms and conditions of said contract <br />shall provide that said installation shall be fully completed <br />by the company on or before May 31~ 1964~ and that in the event <br />that said installation is not completed on or before said date, <br />the company shall be penalized at the rate of $250.00 per day <br />commencing with the first day of June, 1964 and continuing at <br />said rate per day for each day thereafter until said installation <br />is completed. <br /> <br /> <br />
