RESOLUTION NOo 4365 BY: Messrs. Cain, Gaydos, Huffman, Usher, Ward, Wendling. AN EMERGENCY RESOLUTION authorizing the Mayor to enter into a contract for the rental of a portion of the city garage located at 12500 Berea Road, to West Side Pontiac, Inco, on a month to month basis, at a rental of $300 per month. WHEREAS, the City has no present need, for munici- pal purposes, of the large room located in the southwest portion of the City Garage, 12500 Berea Road, Lakewood, Ohio, and, WHEREAS, It is deemed to be in the best interest of the City to derive income from said space, and, WHEREAS, West Side Pontiac, Inc. has offered to rent said room for the storage of automobiles at a monthly rental of three hundred dollars ($300.00), and, WHEREAS, This resolution constitutes an emergency measure for the usual daily operation of a municipal department; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1o That the Mayor be and he is hereby authorized and directed to enter into a contract for the rental of the large room located in the southwest portion of the City Garage, 12500 Berea Road, Lakewood, Ohio, comprising approxi- mately 9600 square feet of floor space subject to the following conditions: A. Said contract shall be on a month to month basis and the rental therefore shall be at the rate of three hundred dollars per month. B. Said contract shall be subject to termination by either party upon notice in writing at least 30 (thirty) days prior to the termination date° C. West Side Pontiac, Inc. shall use the premises for the storage of automobiles and for no other purpose. D. The City shall not furnish heat, light or any other utilities nor shall it furnish watchman service. E. All automobiles stored therein shall be at the sole risk of West side Pontiac, Inc. and the City shall have no liability whatsoever in regard to said automobiles° F. West Side Pontiac, Inc. shall indemnify and hold the City harmless against all claims, demands and judg- ments for loss, damage or injury to property or person, resulting or occurring by reason of use and occupancy of the premises by West Side Pontiac, Inc. G. West Side Pontiac, Inc. shall use and occupy the premises in a careful, safe and proper manner, and shall not use or allow the premises to be used for any purpose other than as specified herein.
