AS AMENDED - MEETING OCTOBER 5 RESOLUTION NO. 4368 BY: Messrs. Bennett, Cain, Gaydos, Usher, Ward. AN EMERGENCY RESOLUTION advising the Lakewood Board of ZOning and Building Code Appeals that the Lakewood City Council recommends against the granting of any extension or expansion of a non-conforming use in the City of Lakewood pending completion of the Master Plan. WHEREAS~ It has come to the attention of the members of the Lakewood City Council that an application is pending before the Lakewood Board of Zoning and Building Code Appeals wherein the applicant seeks to extend or expand the non-conforming use, towit~ a gasoline station located at 12027 Lake Avenue, and, WHEREAS, Said applicant seeks by this means to obtain permission to repair automobiles, operate vending machines and conduct an automobile rental agency, and, WHEREAS, In the opinion of this Council the best inter- ests of the City of Lakewood, its residents and the immediate neighborhood would suffer irreparably from such an extended or expanded non-conforming use; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEW00D, STATE OF OHIO: Section 1. That the Lakewood Board of Zoning and Building Code Appeals be and the same is hereby strenuously urged to reject the application for an extended or expanded use now pending before it in regard to the premises known as 1R027 Lake Avenue, Lakewood, Ohio. Section 2. That the Clerk of the Council be and she is hereby authorized and directed to immediately transmit a copy of this resolution to the Lakewood Board of Zoning and Building Code Appeals. Section 3. That this resolution is hereby declared to be an emergency measure and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
