RESOLUTION NO. 4376 BY: <br /> <br />Messrs. <br /> <br />Gaydos, Huffman, <br />Usher, Ward; <br />Wendling, Bennett, <br />Cain. <br /> <br /> AN EMERGENCY RESOLUTION declaring the intent of <br />the Council of the City of Lakewood to vacate those portions <br />of West Clifton Road between Clifton Boulevard Extension <br />( u.S.Route 6) and Clifton Road in the City of Lakewood, <br />reserving, however, to the City of Lakewood, easements for <br />maintenance and/or reconstruction of water lines, sanitary <br />and storm sewers° <br /> <br /> WI~EREAS, This resolution constitutes an emergency <br />measure providing for the immediate preservation of the public <br />health, safety and welfare and for the usual daily operation of <br />a municipal department; now, therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />LAKEWOOD, STATE OF OHIO: <br /> <br /> Seution 1. That it hereby declares its intent <br />to vacate those portions of West Clifton Road between Clifton <br />Boulevard Extension ~.S.Route 6) and Clifton Road in the City <br />of Lakewood, reserving, however, to the City of Lakewood, <br />easements for maintenanc~ and/or reconstruo%ion of water lines, <br />sanitary and storm sewers, now located in the area intended to <br />be vacated~all as shown on Map No. P 82 F of the Division of <br />Engineering, City of Lakewood, Ohio. <br /> <br /> Section 2. That the Clerk of Council Shall cause <br />notice of such declaration to be served in the manner that the <br />service of summons is required to be made, upon all persons <br />whose property abuts upon the part of West Clifton Road affected <br />by the proposed vacation, and by publication once in one news- <br />paper of general circulation in the City of Lakewood as to all <br />persons who cannot be personally served. Said notice shall <br />state the time and place when objections can be heard before <br />the Board of Revision of Assessments. <br /> <br /> Section 3. That this resolution is hereby declared <br />to be an emergency measure for the reasons stated in the pre- <br />amble hereof and provided it receives the affirmative vote of <br />two-thirds of all members elected to Council, it shall take <br />effect and be in force immediately upon its adoption and approv- <br />al by the Mayor° <br /> <br />Adopted: December <br /> <br />John Gaydos, Jr. <br /> President <br /> <br />Approved: <br /> <br />December. 10,. ~.~4 <br /> <br /> Robert M.
