RESOLUTION NO. 4440 BY: Messrs. Cain, Gaydos, Huffman, Usher, Ward, Wendling, Bennett. AN ER~RGENCY RESOLUTION authorizir~ and directing the Finance Director of the City of Lakewood to accept the principal and interest on special assessment levied on permanent parcel number 315-7-11 on the Cuyahoga County Auditor's records and authorizing the County Auditor to cancel said special assessment for the years 1966 and 1967. WIiEREAS, the City has special assessment charged against the property hereinafter described and levied under Ordinance No. 15-63 adopted by the Council of the City of Lakewood on March 18~ 1965, ands WHEREAS, The owner of the said property has tendered pay- ment of the principal portion and interest on the special assess- ment levied on said parcel pursuant to the provisions of Section 5719.16 of the Revised Code of the State of Ohio, and, WHEREAS, This resolution constitutes an emergency measure providing for the usual daily operation of a municipal depart- merit; now, therefore~ BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Director of Finance of the City of Lakewood be and he is hereby authorized and directed to accept the sum of $108.16 tendered in payment of the principal and inter- est for the years 1966 and 1967 of specmal assessment charged' against the property described as permanent parcel number 315-7-11 on the Auditor's records of Cuyahoga County, Ohio, and levied un-. der Ordinance No. 15-63, adopted by the Council of the City of Lakewood on March 18~ 1963. Section 2. That said special assessment as hereinbefore set forth having been accepted as set forth in Section 1 hereof, and the Auditor of Cuyahoga County be and he is hereby author- ized to cancel said special assessmen~c for the years 1966 and 1967 levied under Ordinance No. 15-63~ adopted by the Council of the City of Lakewood on March 18, 1963 on permanent parcel number 315-7-11 on the County Auditor's records and further described as being in the Ezra Nicholson-Grace Avenue Allotment, each an- nual assessment being in the amount of $54.08. Section 3. That the Clerk of Council be and she is hereby authorized and directed to deliver a certified copy of this res- olution to the Auditor of Cuyahoga County for the purpose of hav- ing said special assessment canceled. Section ~. That this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council~ it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
