RESOLUTION NO. 45~9 <br /> <br />By:Huffman, Kelley, Usher, Ward, <br /> Gaydos, Cain <br /> <br />AN EMERGENCY RESOLUTION authorizing and directing the Director of Law <br />to defend the suits recently filed against the Boards of Trustees of <br />the Lakewood Police Relief and Pension Fund a~d the Lakewood Firemen~s <br />Relief and Pension Fund and the individual Trustees thereof. <br /> <br />WHEREAS, certain beneficiaries of the Lakewood Police Relief and <br />Pension Fund and the Firemeu's Relief and Pension Fund have corrm~enced <br />lawsuits against the respective Boards of Trustees and the individual <br />Trustees of said Funds, and <br /> <br />WHEREAS, said Boards of Trustees have requested the Director of Law <br />to defend said suits on their behalf, and <br /> <br />WHEREAS, said suits may result in monetary loss to the City of <br />Lakewood, in the event of an adverse decision, and, <br /> <br />WHEREAS, this resolution constitutes an emergency measure in that ig <br />provides for the immediat~ preservation of the public welfare and for <br />the usual daily operation of a municipal department, now therefore, <br /> <br />B E IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That the Director of Law be and he is hereby authorized <br />and directed to defend, on behalf of the Boards of Trustees of the <br />Lakewood Police Relief and Pension Fund and the Firemen's Relief and <br />Pension Fund and the individual Trustees thereof, the lawsuits <br />known as Cuyahoga County Common Pleas Court Case Nos. 837948 and <br />837949. <br /> <br />Section 2.
