RESOLUTION NO. 46 48 BY: Me~srs. Kelley, Usher, Graberj <br /> Gayd s, Ward <br /> <br /> AN EMERGENCY RESOLUTION authorizing the Director of Public <br />Works to employ the services of the Ohio Pipe & Supply Company <br />to repair the gas well in Lakewood Park, without competitive <br />bidding. <br /> <br /> WHEREAS, On or about June 17, 1968, the Ohio Pipe & Supply <br />Company started necessary exploratory operations to determine <br />where the gas well in Lakewood Park was leaking, and, <br /> <br /> WHEREAS, <br />way to repair <br /> <br /> WHEREAS, <br />is mandatory, <br /> <br />Thereafter it was then discovered that the only <br />the well was with new 1½" tubing, and, <br /> <br />Immediate replacement of the deteriorated tubing <br />and, <br /> <br /> WHEREAS, The exigencies of the situation demand that replace- <br />ment be made forthwith, and, <br /> <br /> WHEREAS, The City does not have the necessary equipment and <br />manpower to perform the replacement, and, <br /> <br /> WHEREAS, A delay in order to comply with the competitive <br />bidding requirement of the Charter of the City of Lakewood, will <br />be dangerous to the health, safety, and welfare of the citizens <br />of Lakewood, and, <br /> <br /> WH.E-~E~S%This~ reso~lutionconstitutes an emergency in that it <br />provides for the immediate preservation of the public health, <br />safety, welfare and property and provides for the usual daily <br />operation of a municipal department; now, therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO: <br /> <br /> Section 1. That the Director of Public Works be and he is <br />hereby authorized to engage the Ohio Pipe & Supply Company to <br />repair the gas well in Lakewood Park without complying with the <br />competitive bidding-requirements of Article V, Section 3 of the <br />Charter of the City of Lakewood~ <br /> <br /> Section 2. That the Director of Finance is hereby authorized <br />and directed to pay to the Ohio Pipe & Supply Company for equip- <br />ment, material and labor necessary to make the replacement to <br />said gas lines, not to exceed Five Thousand and Five Hundred <br />Dollars ($5,500.00). Said sum to be charged to the General Fund - <br />Park Appropriation. <br /> <br /> Section 3. That this resolution is hereby declared to be <br />an emergency measure for the reasons stated in the preamble hereof <br />and provided it receives the affirmative vote of two-thirds of all <br />members elected to Council it shall take effect and be in force <br />immediately upon its adoption and approval by the Mayor. <br /> <br />Adopted: July !, 1968 .
