RESOLUTION NO. 4676 <br /> <br />BY: Messrs. Gaydos, Graber, Huffman, Kelley, <br /> Usher, Wendling <br /> <br />AN EMERGENCY RESOLUTION declaring the intent of the Council of <br />the City of Lakewood to vacate that portion of Thoreau Avenue <br />from Clifton Boulevard to a point south, approximately 730 feet, <br />as indicated on Map P 19 A by the red shaded portion thereof. <br /> <br />WHEREAS, This resolution constitutes an emergency measure pro- <br />viding for the immediate preservation of the public health, <br />safety and welfare and for the usual daily operation of a <br />municipal department; now, ~herefore~ <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAREWOOD, STATE OF <br />OHIO: <br /> <br />Section 1. That the Council of the City of Lakewood hereby declares <br />its intent to vacate that portion of Thoreau Avenue from Clifton <br />Boulevard to a point south approximately 730 feet, as indicated <br />on Map P 19 A of the Division of Engineering, City of Lakewood, <br />Ohio. <br /> <br />Section 2. That the Clerk of Council shall cause notice of such <br />declaration to be served in the manner that the service of suramons <br />is required to be made, upon all persons whose property abuts <br />upon the part of Thoreau Avenue affected by the proposed vaca- <br />tion, and by publication once in one newspaper of general cir- <br />culation in the City of Lakewood as to all persons who cannot <br />be personally served. Said notice shall state the time and place <br />when objections can be heard before the Board of Revision of <br />Assessments. <br /> <br />Section 3. That this resolution is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof <br />and provided it receives the affirmative vote of two-thirds of <br />all members elected to CounciL, it shall take effect and be in <br />force immediately upon its adoption and approval by the Mayor. <br /> <br />Adopted: <br /> <br />Approved: <br /> <br />December 16, 1968 <br /> <br />December 16, 1968 <br /> <br />President / <br />Clerk l/ <br /> <br />M~yor <br /> <br /> <br />
