RESOLUTION NO. 4683 <br /> <br />BY:. ~essrs.~ Gaydos, Huff man, <br /> l{elley, Usher, Ward, Wendli~ <br /> <br /> AN EMERGENCY RESOLUTION declaring the necessity and <br />intent of the City of Lakewood, Ohio, to appropriate certain real <br />property located at 1377 Gladys Avenue in the City of Lakewood, <br />owned by Ronald W. Nader and Paddy A. Nader, bearing permanent <br />parcel number 312-14-21, and declaring an emergency. <br /> <br /> WHEREAS, The real property hereinafter more fully <br />described is needed for the purpose of construction af off-street <br />parking facilities, and~ <br /> <br /> WHEREAS, This resolution constitutes an emergency <br />measure providing for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That this Council hereby declares the <br />necessity and intent to appropriate the fee simple title in and <br />to the following described parcel of real estate necessary in <br />connection with the construction of off-street parking facilities <br />pursuant to or in accordance with Article XVIII of the Charter of <br />the City of Lakewood, and the Constitution and laws of the State <br />of Ohio, to-wit: <br /> <br />1377 Gladys Avenue - Permanent Parcel No. 312-14-21: <br /> <br />Situated in the City of Lakewood, County of Cuyahoga and <br />State of Ohio, and known as being part of Original Rockport <br />Township Section NCo 22, and bounded and described as follows~ <br /> <br />Beginning on the Easterly llne of Gladys Avenue, as dedicated <br />by plat recorded in Volume 33 of Maps, Page 5 of Cuyahoga <br />County Records, at the Northwesterly corner of land conveyed <br />to Mary E. Loew by Deed dated March 19, 1908 and recorded in <br />Volume 1136, Page 555 of Cuyahoga County Records; thence <br />Southerly along said Easterly line of Glady$ Avenue 40 feet; <br />thence Easterly and parallel with the Northerly line of <br />land so conveyed to Mary E. Loew, about 100.24 feet to the <br />Easterly line thereof; thence Northerly along the Easterly <br />line of land so conveyed to Mary E. Loew, 40 feet to the <br />Northeasterly corner thereof; thence Westerly along the <br />Northerly line of lan_d/conveyed, about 100.24 feet to the <br />place of beginning and being further known as the Northerly <br />40 feet of Sub Lot No. 4 in Wigmore and Stuart's proposed <br />Subdivision, be the same more or less, but subject to all <br />legal highways. <br /> <br /> Section 2. That the Clerk of Council be and she is <br />hereby authorized to cause written notice of the adoption of th!is <br />resolution to be given to the owner, person in possession thereof <br />or having an interest of record in the above-described premises or <br />to his authorized agent and said notice shall be served by a <br />person designated for the purpose by said Clerk of Council and <br />return made in the manner provided by law. <br /> <br />Section 3.
