RESOLUTION NO. 4734 <br /> <br />BY: Messrs. Graber, Huffman, Kelley, <br /> Usher, Ward, Wendling, Gaydos <br /> <br /> AN EMERGENCY RESOLUTION authorizing the Director <br />of Public Works to advertise for bids for the sale of certain <br />real estate located at 12600 Lake Avenue in the City of Lakewood, <br />which property is now owned by the City of Lakewood and is not <br />needed for any municipal purpose. <br /> <br /> W!iEREAS, The said real property owned by the City <br />of Lakewood is no longer needed for any municipal purpose, and, <br /> <br /> WHEREAS, This resolution constitutes an emergency <br />measure in that it provides for the immediate preservation of <br />the public health, safety and welfare and for the usual daily <br />operation of a municipal department; now, therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Director of Public Works is <br />hereby authorized to advertise for bids for the sale of two <br />parcels of real estate now owned by the City of Lakewood, located <br />at 12600 Lake Avenue, and known as Sublot Numbers 1 and 8, and <br />further designated as Permanent Parcel Numbers 312-9-2 and <br />312-9-11, respectively. <br /> <br /> Section 2. That said advertisement shall state that <br />any contract for the sale of said property shall be subject to <br />the approval of Council; that the conveyance will be by the usual <br />form of warranty deed used by the City, and shall be subject to <br />taxes and assessments, both general and special, if any, all of <br />which shall be prorated as of the date of filing the deed for <br />record and subject to restrictions, conditions and reservationS <br />of record and zoning ordinances; that the escrow fee shall be <br />paid one-half by the City and one-half by the purchaser; that <br />the minimum bid shall be $ 25~000 , and that the City reserves <br />the right to reject any and all bids, or any part thereof. <br /> <br /> Section 3. That this resolution is hereby declared <br />to be an emergency measure for the reasons stated in the preamble <br />hereof and provided it receives the affirmative vote of two-thirds <br />of all members elected to Council, it shall take effect and be in <br />force immediately upon its adoption and approval by the Mayor. <br /> <br />Pr~ident <br />Mayor <br /> <br /> <br />
