RESOLUTION NO. 4752 BY: <br /> <br />Messrs. Kelley, Usher, Ward, <br />Wendling, Gaydos, Graber, <br />Huffman <br /> <br />AN EMERGENCY RESOLUTION authorizing and directing the Finance Director of the <br />City of Lakewood to accept the principal and interest on special assessment <br />levied on permanent parcel number 313-26-179, and known for street numbering <br />purposes as 1555 Orchard Grove Avenue, on the Cuyahoga County Auditor's records <br />and authorizing the County Auditor to cancel said special assessment for the <br />ye'ars 1970 and 1971. <br /> <br />WHEREAS, The City has special assessment charged against the property herein- <br />aflter described and levied under Ordinance 36-66, adopted by the Courmil of the <br />City of Lakewood on April 18, 1966, and, <br /> <br />WHEREAS, The owner of the said property has tendered payment of the principal <br />porti~on and interest on the special assessment levied on said parcel pursuant <br />to the provisions of Section 5719.16 of the Revised Code of the State of Ohio, <br />and, <br /> <br />WHEREAS, This resolution constitutes an emergency measure providing for the <br />usual daily operation of a municipal department, now, therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That the Director of Finance of the City of Lakewood be and he is <br /> hereby authorized and directed to accept the sum of $29.24 tendered in payment <br /> of the principal and interest for the years 1970 and 1971, of special assessment <br /> charged against the property described as permanent parcel number 313-26-179 <br /> on the Auditor's records of~Cnyahoga County, Ohio and levied under Ordinance <br /> No. 36-66, adopted by the Council of the City of Lakewood on April 18, 1966. <br /> Section 2o That said special assessment as hereinbefore set forth having been <br /> accepted as set forth in Section 1 hereof, and the Auditor of Cuyahoga County <br /> be and he is hereby authorized to cancel said special assessment for the years <br /> 1970 and 1971, levied under Ordinance Noo 36-66, adopted by theCouncil of the <br /> City of Lakewood on April 18, 1966, on permanent parcel number 313-26-179, on <br /> the Pumphrey Realty "Orchard Grove" Division, Volume 30, page 5, each annual <br /> assessment being in the amount of $14.62. <br /> <br /> Section 3. That the Clerk of Council be and she is hereby authorized and <br /> directed to deliver a certified copy of this resolution to the Auditor of <br /> Cuyahoga County for the purpose of having said special assessment canceled. <br /> <br /> Section 4. That this resolution is hereby declared to be an emergency measure <br /> for the reasons stated in the preamble hereof and provided it receives the <br /> affirmative vote of two-thirds of all members elected to Council, it shall take <br /> effect and be in force immediately upon its adoption and approval by the Mayor. <br /> <br />Adopted:,, <br /> <br />President/ <br />Cler~ <br /> <br /> <br />
