RESOLUTION NO. 4752 BY: Messrs. Kelley, Usher, Ward, Wendling, Gaydos, Graber, Huffman AN EMERGENCY RESOLUTION authorizing and directing the Finance Director of the City of Lakewood to accept the principal and interest on special assessment levied on permanent parcel number 313-26-179, and known for street numbering purposes as 1555 Orchard Grove Avenue, on the Cuyahoga County Auditor's records and authorizing the County Auditor to cancel said special assessment for the ye'ars 1970 and 1971. WHEREAS, The City has special assessment charged against the property herein- aflter described and levied under Ordinance 36-66, adopted by the Courmil of the City of Lakewood on April 18, 1966, and, WHEREAS, The owner of the said property has tendered payment of the principal porti~on and interest on the special assessment levied on said parcel pursuant to the provisions of Section 5719.16 of the Revised Code of the State of Ohio, and, WHEREAS, This resolution constitutes an emergency measure providing for the usual daily operation of a municipal department, now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Director of Finance of the City of Lakewood be and he is hereby authorized and directed to accept the sum of $29.24 tendered in payment of the principal and interest for the years 1970 and 1971, of special assessment charged against the property described as permanent parcel number 313-26-179 on the Auditor's records of~Cnyahoga County, Ohio and levied under Ordinance No. 36-66, adopted by the Council of the City of Lakewood on April 18, 1966. Section 2o That said special assessment as hereinbefore set forth having been accepted as set forth in Section 1 hereof, and the Auditor of Cuyahoga County be and he is hereby authorized to cancel said special assessment for the years 1970 and 1971, levied under Ordinance Noo 36-66, adopted by theCouncil of the City of Lakewood on April 18, 1966, on permanent parcel number 313-26-179, on the Pumphrey Realty "Orchard Grove" Division, Volume 30, page 5, each annual assessment being in the amount of $14.62. Section 3. That the Clerk of Council be and she is hereby authorized and directed to deliver a certified copy of this resolution to the Auditor of Cuyahoga County for the purpose of having said special assessment canceled. Section 4. That this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
