RESOLUTION NO. 4774 BY: Messrs. Gaydos, Graber~ Iluffman, Usher, Ward, Wendling AN EMERGENCY RESOLUTION authorizing and directing the Finance Director of the City of Lakewood to accept the principal and interest on special assessment levied on permanent parcel number 311-31-71, and known for street numbering purposes as 1208 Brockley Avenue, on the Cuyahoga County Auditor's records and authorizing the County Auditor to cancel said special assessment for the years 1970, 1971, 1972, 1973. WHEREAS, The City of Lakewood has special assessmant charged against the property hereinafter described and levied under Ordinance No. 16-69, adopted by the Council of the City of Lakewood on March 3, 1969, and WHEREAS, the owner of the ~aid property has tendered payment of the principal portion and interest on the special assessment levied on said parcel pursuant to the provisions of Section 5719.16 of the Reviaed Code of the State of Ohio, and WHEREAS, this resolution constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore: BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Director of Finance of the City of Lakewood be and he is hereby authorized and directed to accept the sum of $73.76 tendered in payment of the principal and interest for the years 1970, 1971, 1972 and 1973 of special assessment charged against the property described as permanent parcel number 311-31-71 on the Auditor's records of Cuyahoga County, Ohio, and levied under Ordinance No. 16-69, adopted by the Council of the City of Lakewood on March 3, 1969. Section 2. That said special assessment as hereinbefore set forth having been accepted as set forth in Section 1 hereof, and the Auditor of Cuyahoga County be and he ia hereby authorized to cancel said special assessment for the years 1970, 1971, 1972 and 1973 levied under Ordinance No. 16-69, adopted by the Council of the City of Lakewood on March 3, 1969 on permanent parcel number 311-31-71 on the County Auditor's records and further described as being in the Delmar Subdivision Volume 24, Page 23, each annual assessment being in the amount of $18.44. Section 3. That the Clerk of Council be and she is hereby authorized and directed to deliver a certified copy of this resolution to the Auditor of Cnyahoga County for the purpose of having said special assessment canceled. Section 4. That this reaolntion is hereby declared to be an emergency measure for the reasons .stated in the preamble hereof and provided it receives the affirmative vote of two~thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
