RESOLUTION NO. 4774 <br /> <br />BY: Messrs. Gaydos, Graber~ Iluffman, <br /> Usher, Ward, Wendling <br /> <br />AN EMERGENCY RESOLUTION authorizing and directing the Finance Director <br />of the City of Lakewood to accept the principal and interest on special <br />assessment levied on permanent parcel number 311-31-71, and known for <br />street numbering purposes as 1208 Brockley Avenue, on the Cuyahoga County <br />Auditor's records and authorizing the County Auditor to cancel said <br />special assessment for the years 1970, 1971, 1972, 1973. <br /> <br />WHEREAS, The City of Lakewood has special assessmant charged against the <br />property hereinafter described and levied under Ordinance No. 16-69, <br />adopted by the Council of the City of Lakewood on March 3, 1969, and <br /> <br />WHEREAS, the owner of the ~aid property has tendered payment of the principal <br />portion and interest on the special assessment levied on said parcel pursuant <br />to the provisions of Section 5719.16 of the Reviaed Code of the State of <br />Ohio, and <br /> <br /> WHEREAS, this resolution constitutes an emergency measure providing for <br /> the usual daily operation of a municipal department; now, therefore: <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That the Director of Finance of the City of Lakewood be and he <br />is hereby authorized and directed to accept the sum of $73.76 tendered in <br />payment of the principal and interest for the years 1970, 1971, 1972 and 1973 <br />of special assessment charged against the property described as permanent <br />parcel number 311-31-71 on the Auditor's records of Cuyahoga County, Ohio, <br />and levied under Ordinance No. 16-69, adopted by the Council of the City <br />of Lakewood on March 3, 1969. <br /> <br />Section 2. That said special assessment as hereinbefore set forth having <br />been accepted as set forth in Section 1 hereof, and the Auditor of Cuyahoga <br />County be and he ia hereby authorized to cancel said special assessment <br />for the years 1970, 1971, 1972 and 1973 levied under Ordinance No. 16-69, <br />adopted by the Council of the City of Lakewood on March 3, 1969 on permanent <br />parcel number 311-31-71 on the County Auditor's records and further described <br />as being in the Delmar Subdivision Volume 24, Page 23, each annual assessment <br />being in the amount of $18.44. <br /> <br />Section 3. That the Clerk of Council be and she is hereby authorized and <br />directed to deliver a certified copy of this resolution to the Auditor of <br />Cnyahoga County for the purpose of having said special assessment canceled. <br /> <br />Section 4. That this reaolntion is hereby declared to be an emergency measure <br />for the reasons .stated in the preamble hereof and provided it receives the <br />affirmative vote of two~thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor. <br /> <br />Approved: <br /> <br />Clerk <br /> <br />Mayor <br /> <br /> <br />
