)'lt,~[;OLUTi )' NO. 4787 <br /> <br />~ · Messrso Graber, tluffman, Usher, Ward, Wendling <br /> <br /> AN EMERGENCY RESOI.U']~ION declaring it necessary to improve a <br />certain easement o£ tile City of L~d;ewooR along a privately owned roadway <br />in Cli£ton Park Lagoon con~non].y known as Beach Road by thc construction <br />of a sanitary sewe~~, pumping ntation and force main, together with curb <br />connections therefor and other necessary appurtenances thereto. <br /> }~{EREAS, ~this Council by two-thirds vote of the members elected <br />thereto determines that this resolution is an emergency measure which is <br />necessary for the in~ncdiate preservation of the public peace, property, <br />health and safety and for the further reason that the hnprovemcnts herein <br />provided are zmmed~tely necessary to protect thc health and property of <br />the abutting o~n~ers and the znhabztm~to of the City by providing sanitary <br />sewerage nervice to an unse~ered area of the City; <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br /> L~Jcewood, Cuyal~oga County, State of 0hio~ three-fourths of all members <br /> elected t]~ereto concurring: <br /> <br /> Section 1. That it is necessary to improve an easement of the <br /> City described as follows: <br /> <br /> Situated in the City of L~ewood, County of Cuy~hoga <br /> and State of Ohio and known as being part of the Clifton <br /> Park Land and Improvement Company as recorded in Volume <br /> 29, page ll, of Cuyahoga County Records and being also <br /> part of Clifton Park Land and Improvement Company's <br /> Allotment Nmuber 2, as recorded in Volume 48, page 3 <br /> and bounded and ~ez~cribed as follows: <br /> Commencing at the stone monument at the Southwesterly <br /> corner of Beach Road and Lake Road in the said sub- <br /> division, thence South 61° 42' 30"~ West, a distance of <br /> about 187.77 feet to a manhole.which is the principal place <br /> of beginning of the easement hereby described; thence five <br /> feet on both sides of a line running North 66© 17' '30" <br /> West a distance of about 196.32 feet to a point, thence <br /> North 43° 47' 30" West a distance of about 70.28 feet to <br /> a point, thence North 21° 17' 30" West a distance of about <br /> 184.75 feet to a point, thence North 04° 25' 30" West a <br /> distance of about 21.50 feet to a point, thence North 26° <br /> 55' 30" West, a distance of about 28.25 feet to a point, <br /> thence North 71° 55' 30" West, a distance of about 100 <br /> feet to a point which will be the location of the proposed <br /> pump station, thence North 65° 35' lO" West a distance of <br /> about 38.00 feet to a proposed manhole "A" which will be <br /> located in the Clifton Park Laud and Improvement Company's <br /> Allotment N~mber 2, as shown by the recorded plat in Volt,me <br /> 48 of Maps, page 3 of Cuyahoga County Records, thence North <br /> 12° 57' 30" Nest a distance of about 422.00 feet to a point, <br /> thence North 64° 46' 50" West a distance of about 200.55 feet <br /> to a point, thence South 77" 02' 30" West a distance of <br /> about 230.00 feet, thence back along said easement to said <br /> proposed manhole "A" thence South 27° 44' 15" West a distance <br /> of about 160.00 feet to a point, thence South 46° 35' 15" <br /> West a distance of about 173.50 feet to a point, thence North <br /> 37° 36' 25" West a distance of about 261.70 feet to a point, <br /> thence North 44° 32' 45" West a distance of about 334.85 feet <br /> to a point which will terminate said easement. <br /> <br /> <br />
