RESOLUTION NO. 4799 BY: Messrs. Kelley, Usher, Ward, Gaydos, Graber, Huffman AN EMERGENCY RESOLUTION requesting the Auditor of Cuyahoga County to draw and the Treasurer of Cuyaboga County to pay to the Director of Finance of the City of Lakewood an advance of taxes collected for ti~e fiscal year 1971 in such amounts ss may be requested and available. WHEREAS, Section 321.34 of the Ohio Revised Code contains provision for local authorities by resolution to so request, the County Auditor to draw and the County Treasurer to pay on such draft to treasurers of municipal corporations, whose funds derived from taxes or other sources are payable by law to the County Treasurer, any money that may be in the county treasury to the accounts of such local authorities; and, WHEREAS, It will be necessary for the City of Lakewood to obtain advances of taxes prior to the regular tax settlements for the year, and, WHEREAS, This resolution constitutes an emergency measure providing for the immediate preservation of the public property and for the usual daily operation of a municipal department; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Auditor ot Cuyahoga County be requested to draw and the Treasurer of Cuyahoga County be requested to pay to the Director of Finance of the City of Lakewood, State of Ohio, advances of taxes for the fiscal year 1971 in such amounts as may be requested to him and which are available. Section 2. That this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof, and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor. ~/ -. / Vice P~esident Ac;~ng Clerk Mayor
