RESOLUTION NO. 4835 <br /> <br />Messrs. Kelley, Usher, Ward, Wendling, <br />Crsber, Huffmsn <br /> <br />AN EMERGENCY RESOLUTION authorizing and directing the Finance Director of <br />the City of Lakewood to accept the principal and interest on special assess- <br />ment levied on permanent parcel number 311-32-132, and known for street <br />numbering purposes as 1263 Brockley Avenue, on the Cuyahoga County Auditor's <br />records and authorizing the County Auditor to cancel said special assessment <br />for the years 1971 through 1973. <br /> <br />WHEREAS, The City of Lakewood has special assessment charged against the <br />property hereinafter described and levied under Ordinance No. 16-69, adopted <br />by the Council of the City o.f Lakewood on March 3, 1969, and, <br /> <br />WHEREAS, The owner of the said property has tendered payment of the principal <br />portion and interest on the special assessment levied on said parcel pursuant <br />to the provisions of Section 5716.16 of the Revised Code of the State of Ohio, <br />and, <br /> <br />WHEREAS, This resolution constitutes an emergency measure ~rovidtng for the <br />usual daily operation of a municipal department; now, therefore: <br /> <br />BE IT KESOLVED BY THE COUNCIL OF THE CITY OF LAKE"WOOD, STATE OF OHIO: <br /> <br />Section I. That the Director of Finance of the City of Lakewood be and he is <br />hereby authorized and directed to accept the sum of $55.32 tendered in payment <br />of the principal and interest for the years 1971-1973, of special assessment <br />charged against the property described as permanent parcel number 311-32-132 <br />on the Auditor's records of Cuyahoga County, Ohio, and levied under Ordinance <br />NOo 16-69, adoptedby the Council of the City of Lakewood on March 3, 1969. <br /> <br />Section 2. That said special assessment as hereinbefore set forth having been <br />accepted as set forth in Section 1 hereof, and the Auditor of Cuyahoga County <br />he and he is hereby authorized to cancel said special assessment for the years <br />1969 through 1971, levied under Ordinance No. 16-69, adopted by the Council of <br />the City of Lakewood on March 3, 1969, on permanent parcel number 311-32-132 on <br />the County Auditor's Records and further described as being in the H. Barrett <br />Re-subdivision, Volume 28, page 8, each annual assessment being in the amount <br />of $18.44. <br /> <br />Section 3. That the Clerk of Council be and she is hereby authorized and <br />directed to deliver a certified copy of this resolution to the Auditor of <br />Cuyahoga County for the purpose of having said special assessment canceled. <br /> <br />Section 4. That this resolution is hereby declared to be an emergency measure <br />for the reasons stated in the preamble hereof and provided it receives the <br />affirmative voge of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor. <br /> <br />Adopted: ~~/~1~1 <br /> <br />Approved: <br /> <br />Mayor <br /> <br /> <br />
