R~SOLUTION NOt 4889 BY: Messrs. Graber, Kelley, McBr{de, Magnotto, Usher, Wendling, Brockman AN EM~ERGENCY RESOLUTION authorizing and directing the Finance Director of the City of Lakewood to accept the principal and interest o~ special assessment levied on permanent parcel number 311-31-091, and knovm for street numbering purposes as 1180-82 Summit Avenue, on the Cuyahoga County Auditor's records and authorizing the County Auditor to cancel said special assessment for the years 1972 through 1974. WHEREAS, the City of Lakewood has special assessment charged against the property hereinafter described and levied under Ordinance No. 45-70, adopted by the Council of the City of Lakewood on July 20, 1970, and WHEREAS, the owner of the said property has tendered payment of the principal portion and interest on the special assessment levied on said parcel pursuann no the provisions of Section 5719.16 of the Revised Code of the State of Ohio. and WHEREAS, this resolution constitutes an emergency measure providing for the usual daily operation ~f a municipal department; now, therefore: BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD~ STATE OF OHIO: Section 1. That the Director of Finance of the City of Lakewood be and he is hereby authorized and directed no accep~ the sum of S71.76 tendered in paymen~ o~ the principal and interesn for the years 1972 through 1974, of special assessmann charged against the properny described as permanenn parcel number 311-31-091 on the Auditor's records of Cuyahoga County, Ohio. and levied un~er Ordinance No. 45-70 adopted by the Council of the City of Lakewood on July 20, 1970. Section 2. Ihat said special assessment as hereinbefore sen forth having been ~ccepted as sen forth in Section 1 hereof, and the Auditor of Cuyahoga County be ~nd he is hereby authorized ~o cancel said special assessment for the years 1972 through 1974 levied under Ordinance No. 45-70~ adopted by the Council o~ the City of Lakewood on July 20, 197C. on permanent parcel number 311-31-091 on the County Auditor's records and further described as being in the Jennie Andrews Subdivision, Volume 31 Page 26, each annual assessmen~ being in the amoun~ o~ S23.92. Section 3. That the Clerk of Council be and she is hereby authorized and directed no deliver a certified copy of this resolution to the Auditor of Cuyahoga County for the purpose of having said special assessmen~ canceled. Section 4. ~at this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force irmmediately upon its adoption and approval by the Mayor.
