RESOLUTION NO. 4931 <br /> <br />BY: Messrs. Brockman, Graber, Magnotto, <br /> McBride, Usher, Wendling <br /> <br />AN EMERGENCY RESOLUTION requesting the assistance of the Federal Insurance <br />Administration in making available Federal flood insurance protection for <br />residents of the Clifton Lagoon area in the City of Lakewood. <br /> <br />WHEREAS, certain areas of Lakewood, namely the clifton Lagoon, are subject <br />to periodic flooding from Lake Erie and Rocky River causing serious damage <br />to residential properties within these areas, and <br /> <br />WHEREAS, relief is available in the form of flood insurance as authorized <br />by the National Flood Insurance ACt of 1968 as amended, and <br /> <br />WHEREAS, it is the intent of this Council to comply with land use and man- <br />agement criteria regulations as required in said act, and <br /> <br />WHEREAS, it is also the intent of this Council to recognize and duly evalu- <br />ate flood hazards in all official actions relating to land use in the flood <br />plain area having special flood hazards, and <br /> <br />WHEREAS, the Code Citations of any State enabling legislation and of any <br />resulting City Charter and Ordinances that authorize this City to adopt <br />land use and control measures are as follows: Ohio Constitution Article <br />XVI%%, Section 3; Lakewood City Charter Article XV, Section 3; Ohio Revised <br />Code, Sections 713.03, 04, 05, 06, 07, and 08; and <br /> <br />~?.WHEREAS, this Resolution constitutes an emergency measure providing for the <br /> immediate preservation of property and for the usual daily operation of a <br /> municipal department; now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That this Council hereby assures the Federal Insurance Administra- <br />tion that it takes the following legislative action: <br /> <br />(A) Appoints the Mayor of the City of Lakewood with the respon- <br /> sibility, authority, and means to: <br /> <br />(i) <br /> <br />Delineate or assist the Administrator, at his request, <br />in delineating the limits of the areas having special <br />flood hazards on available local maps of sufficient <br />scale to identify the location of building sites, <br /> <br />(ii) <br /> <br />Provide such information as the Administrator may <br />request concerning present uses and occupancy of the <br />flood plain area, <br /> <br /><iii) <br /> <br />Maintain for public inspection and furnishing upon <br />request, with respect to each area having special <br />flood hazards, information on elevations in relation <br />to mean sea level of the lowest floors of all new or <br />substantially improved structures; and <br /> <br />(iv) <br /> <br />Cooperate with Federal, State and local agencies and <br />private firms which undertake to study, survey, map, <br />and identify flood plain areas, and cooperate with <br />neighboring communities with respect to management of <br />adjoining flood plain and/or mud slide areas in order <br />to prevent aggravation of existing hazards. <br /> <br />(v) <br /> <br />Submit on the anniversary date of the community's <br />initial eligibility an annual report to the Administrator <br /> <br /> <br />
