RESOLUTION NO. 4931 BY: Messrs. Brockman, Graber, Magnotto, McBride, Usher, Wendling AN EMERGENCY RESOLUTION requesting the assistance of the Federal Insurance Administration in making available Federal flood insurance protection for residents of the Clifton Lagoon area in the City of Lakewood. WHEREAS, certain areas of Lakewood, namely the clifton Lagoon, are subject to periodic flooding from Lake Erie and Rocky River causing serious damage to residential properties within these areas, and WHEREAS, relief is available in the form of flood insurance as authorized by the National Flood Insurance ACt of 1968 as amended, and WHEREAS, it is the intent of this Council to comply with land use and man- agement criteria regulations as required in said act, and WHEREAS, it is also the intent of this Council to recognize and duly evalu- ate flood hazards in all official actions relating to land use in the flood plain area having special flood hazards, and WHEREAS, the Code Citations of any State enabling legislation and of any resulting City Charter and Ordinances that authorize this City to adopt land use and control measures are as follows: Ohio Constitution Article XVI%%, Section 3; Lakewood City Charter Article XV, Section 3; Ohio Revised Code, Sections 713.03, 04, 05, 06, 07, and 08; and ~?.WHEREAS, this Resolution constitutes an emergency measure providing for the immediate preservation of property and for the usual daily operation of a municipal department; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That this Council hereby assures the Federal Insurance Administra- tion that it takes the following legislative action: (A) Appoints the Mayor of the City of Lakewood with the respon- sibility, authority, and means to: (i) Delineate or assist the Administrator, at his request, in delineating the limits of the areas having special flood hazards on available local maps of sufficient scale to identify the location of building sites, (ii) Provide such information as the Administrator may request concerning present uses and occupancy of the flood plain area, <iii) Maintain for public inspection and furnishing upon request, with respect to each area having special flood hazards, information on elevations in relation to mean sea level of the lowest floors of all new or substantially improved structures; and (iv) Cooperate with Federal, State and local agencies and private firms which undertake to study, survey, map, and identify flood plain areas, and cooperate with neighboring communities with respect to management of adjoining flood plain and/or mud slide areas in order to prevent aggravation of existing hazards. (v) Submit on the anniversary date of the community's initial eligibility an annual report to the Administrator
