RESOLUTION NO. 5057 BY: Messrs. Chinnock, Graber Magnotto, McBride, Sioagra, Usher, Brockman AN EMERGENCY RESOLUTION authorizing aad directing the Finance Director of the City of Lakewood to accept the principal and interest on special assessment levied on permanent parcel number 3]3-18-115, and known for street numbering purposes as 17611 Fries Avenue, on the Cuyaboga County Auditor's records and authorizing the County Auditor to cancel said special assessment for the years 1975, 1976, and 1977~ WHEI~AS, the City of Lakewood has special assessment charged against the property hereinafter descrzbed and levied under Ordinance No. 34~73, adopted by the Council of the City of Lakewood on March 5, 1973, and WHEREAS, the owner of the said property has tendered payment of tbe principal portion and interest on the special assessment levied on said parcel pursuant to the provisions of Section 5716.16 of the Revised Code of the S~ate of Dhio, and WHEREAS, this resolution constitutes am emergency measure providing for the usual daily operation of a municipal department; now,therefore: BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Director of FinaeCe of the City of Lakewood be and be is hereby authorized and directed to accept the sum of $176.34 tendered in payment of the principal and interest for the years 1975, 1976 sod 1977, of special assessment charged against the property described as permanent parcel number 313-18-115 on the Auditor's records of Cuyahoga County, Ohio, and levied under Ordinance No. 34-73 adopted by the Council of the City of La~ewood on March 5, 1973. Section 2. That said special assessment as hereinbefore set forth having been accepted as set forth in Section 1 hereof, and the Auditor of Cuyahog~ County be and he is hereby authorized to cancel said special assessment~ for the years 1975, 1976 and 1977, levied under Ordinance' No. 34-73, adopted by the Coungil of the City of Lakewood on March 5, ]973, on permanent parcel . numbe~ 313-18-115 on the County Auditor's Records and further described as being in the Rocky River Nursery Allotment, Volume 53 page 19, each annual assessment being in the amount of $58.78. Section 3. That the Clerk of Council be and she is hereby authorized snd directed to deliver a certified copy of Phis resolution to the Auditor of Cuyahoga County for the purpose of having said special assessment canceled. Section 4. 'i~at this resolution is hereby declared to be an emergency measure for the reasons stated ~n the preamble hereof and provided it re- ceives the affirmative vote of two-thzrds of all members elected to Council, it shall take effect and be in force immediately ~its adoptioj~a~ld approval by the Mayor. ~ Pres~ ~
