RESOLUTION NO. 5079 <br /> <br />BY: Messrs. Graber, McBride, Sinagra, <br /> Usher, Brockman, Chinnock <br /> <br /> AN EMERGENCY RgSOLUTION authorizing and directing the Director of Law <br />to file a declaratory judgment action or other appropriate proceeding in the <br />Common Pleas Court of Cuyahoga County to compel the demolition and removal of <br />the building situated at 13396 Madison Avenue, Lakewood, Ohio, determined to <br />be an unsafe structure and public nuisance. <br /> WHEREAS, pursuant to the provisions of Section 1603.50 of the Building <br />Code of the City of Lakewood, the building located at 13396 Madison Avenue, <br />Lakewood, Ohio bas been declared to be an unsafe structnre by reason of inadequate <br />maintenance, abandonment and dilapidation, and as such unsafe structure has been <br />further declared to be a public nuisance, and <br /> <br /> WHEREAS, the owner of said building has been notified to abate said <br /> nuisance by repair, rehabilitation, demolition or removal of said structure but <br /> has failed to comply with said notice, and <br /> WHEREAS, this Council is of the opinion that appropriate legal action <br /> should be taken immediately so as to abate this public nuisance at the earliest <br /> possible time, and <br /> <br /> WHEREAS, this Resolution constitutes an emergency measure providing for <br /> the in~nediate preservation of the public health, safety and welfare; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That the Director of Law be and he is hereby authorized and <br /> directed to prosecute an action in declaratory judgment or other appropriate <br /> proceeding in the Common Pleas Court of Cuyahoga County against the owners of the <br /> building at 13396 Madison Avenue, Lakewood, Ohio to effect the demolition and <br /> removal of said building. <br /> <br /> Section 2. That this Resolution is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives the <br />affirmative vote of two thirds of all members e,~h~d to Cou~lA it shall take <br />effect and be in force irmnediately up°n its mOp, and ~i~bY the Xay°r' <br /> <br />Approved <br /> <br />Mayor <br /> <br /> <br />
